AGREEMEPdT FOR REIMBURSEMENT FOR <br />MODIFICATIOPdS TO TRAFFIC CONTROL DEVICES <br />THIS AGREEP~NT, made and entered into this / ~ ____ day of <br />1976, by and between UNITED STATES POSTAL SERVICE, <br />hereinafter referred to as "Developer," and THE CITY OF PLEASANTON, <br />hereinafter referred to as "City." <br />W I T N E S S E T H <br />WIiEREAS, Developer is the owner of real property in the City of <br />Pleasanton, County of Alameda, State of California, as described on <br />Exhibit A attached hereto and fully incorporated herein; and <br />WHEREAS, Developer now has under construction a new Post Office <br />facility on aforementioned real property; and <br />WHEREAS, the traffic generated by this new Post Office facility <br />will impact on Black Avenue and Santa Rita Road; and <br />WHEREAS, Developer and City desire to take certain mitigating <br />measures to minimize the impact of the traffic generated by the <br />Post Office facility; and <br />WHEREAS, Developer and City each have certain rersponsabilities <br />as to the mitigating measures to be taken; and <br />WHEREAS, it is desirable to set forth in writing the responsi-~ <br />bil.ities of each party to avoid misunderstaiidir~gs. <br />NOW, TIiEREFORE, IT IS MUTUALI~,1' AGREED BETWI~P,N TIIE PARTIES IIERi,TO <br />AS FOLLOLJS <br />1. Developer agrees to finance the cost of a review of traffic <br />control facilities adjacent: to Post Office site try a c.ornpeterit: <br />Traffic Engineering Consultant to be retained by City. Said review <br />to be in accordance wit'rr letter proposal dated September 9, 1.975, <br />from Tammen, Johnson, Kinzel and Mirtiaga., attached hereto as Exhibit <br />B.
