AGREEMENT FOR INSTALLATION ANll MAIIdTETJANCE OF LANDSCAPING THIS AGREEMENT is made this 10th day of February 19 83 between Texaco Inc., a Delaware corporation, , hereafter referred to as "Property Owner" and the CITY OF PLEASANTON, a municipal corporation, hereafter referred to as "City". R E C I T A L S THIS AGREEMENT IS BASED UFON THE FOLLOWING FACTS: (1) Property owner is tYie owner of real property in the City of Pleasanton described in Exhibit "A", attaciZed to this Agreement and made a part of it by this reference; (2 ) On January 12 , 19 83 , the C ity granted ~ conditional use permit (UP-82-24 approval to said property; (3) By the terms of the Planning Commission approval, property owner is required to install and maintain landscaping in accordance with a plan, to be approved by the Planning Department prior to Build- ing Permit approval; (4) Both. parties recognize that the installation and maintenance of landscaping is an integral part of the property owner's plan for development of the property. NOW, THEREFORE, IT IS AGREED BETWEEN THE PARTIES, as follows: 1. Purpose. The purpose of this Agreement is to assure (a) installation in accordance with the landscaping plan previously approved by the City and (b) continued maintenance and care of the landscaping.
