t <br /> <br />REIlVIBURSEMENT AGREEMENT FOR <br />PARCEL MAP 5831 OFF-SITE IMPROVEMENTS <br />THIS AGREEMENT is entered into at Pleasanton, California, this /~ day of <br />~G~>~ 1990, by and between CITY OF PLEASANTON, Alameda County, <br />California, a municipal corporation ("City") and BRIAN HILARY SCHWALEN ("Developer") <br />with reference to the following facts. <br />A. Developer is the owner of certain real property in the City of Pleasanton, County <br />of Alameda, State of California, commonly known as Pazcel Map 5831 (the "Property"). <br />Developer has obtained City approval of a tentative parcel map for a four lot residential <br />subdivision to be constructed on the Property. <br />B. In connection with construction described above, Developer intends to construct or <br />cause to be constructed certain improvements in Sycamore Road right-of--way area, which <br />improvements will benefit the Property and other properties more fully described below. <br />C. Pursuant to the Subdivision Map Act (California Government Code, Section 66410 <br />et se ,Developer is entitled to reimbursement for certain costs of the improvements referred <br />to above. City will inspect and accept said improvements and is willing to administer the <br />reimbursement costs to Developer as set forth herein. <br />NOW, THEREFORE, IT IS AGREED AS FOLLOWS: <br />1. Improvements. <br />a. Certain construction work to be performed by Developer, consisting of <br />underground utilities which include, but aze not limited to, 881 feet of 8-inch sewer line and 840 <br />feet of 12-inch water line in Sycamore Road, plus related public improvements, will benefit <br />other properties in addition to the Property. Developer is entitled to recover the cost of <br />installation of the 881 feet of 8-inch sewer line and the estimated cost for installation of 840 feet <br />of 8-inch water line as shown on Exhibit "A" from other properties which benefit from these <br />improvements. The construction work to be performed by Developer and included in the off-site <br />improvements is eligible for reimbursement hereunder (collectively, the "Improvements") shall <br />include the work described on Exhibit "A" hereto, which shall be performed at an estimated cost <br />as shown thereon. <br />b. The reimbursement .agreement shall be based upon the estimates of construction <br />cost included in Exhibit A. Within 60 days. after acceptance of the improvements by the City, <br />Developer shall submit actual costs of the construction work, certified by Developer, to the. City <br />Engineer. The City Engineer shall review the estimated costs of the 8-inch water main, if the <br />-1- <br /> <br />
