SAFRENO AND MARY M. SAFRENO, (hereafter referred to <br />as "Property Owner"), SHELL OIL COMPANY A DELAWARE CORPORATION (hereafter <br />referred to as "Lessee") and the CITY OF PLEASANTON, a municipal corporation, <br />(hereafter referred to as "City"). <br />R E C I T A L S <br />THIS AGREEMENT IS BASED UPON THE FOLLOWING FACTS: <br />A. Property Owner is the owner of real property in the City of <br />Pleasanton, County of Alameda, State of California, described in Exhibit "A", <br />attached to this Agreement and made a part of it by this reference (hereafter <br />the "Property"), a 0.2 acre site located on the east side of First Street, <br />approximately 150 feet south of the intersection of Vineyard Avenue and First <br />Street. <br />B. On November 25, 1986, the City granted design review approval for <br />Z-86-386, Shell Oil Company/Safreno on the. Property. <br />C. By the terms of the above approval, Property Owner or Lessee is <br />required to install and maintain landscaping approved by the City. A copy of <br />said landscaping plan is on file in the Planning Department. <br />D. All parties recognize that the installation and maintenance of <br />landscaping is an integral part of the Property Owner's and Lessee's plan for <br />development of the .Property. <br />8702602 <br />L11 <br />
