Palmer and Larry Osborne <br />hereafter referred to as "Property Owner" and the CITY OF PLEASANTON, <br />a municipal corporation, hereafter referred to as "City". <br />R E C I T A L S <br />THIS AGREEMENT IS BASF'D UFON THE FOLLOWING FACTS: <br />(1) Property owner is the owner of real property in the City of <br />Pleasanton described in Exhibit "A", attached to this Agreement and <br />mada a part of it by this reference; <br />(2) On June 14 1979 the City granted ~ <br />Design Review approval to said property; <br />(3) By the terms of the <br />design review approval, property <br />owner is required to install and maintain landscaping in accordance <br />with a plan, to be approved by the Planning Department prior ~o Build- <br />ing Permit approval; <br />(4) Both parties recognize that the installation and maintenance <br />of landscaping is an integral part of the property owner's plan for <br />development of the property. <br />NOW, THEREFORE, IT IS AGREED BETWEEN THE PARTIES, as follows: <br />1. Purpose. The purpose of this Agreement is to assure (a) <br />installation in accordance with the landscaping plan previously <br />approved by the City and (b) continued maintenance and care of the <br />landscaping. <br /> <br />
