SANITAP.Y SEWEP. LIFT STATION MAIPdTENAPdCE AGPEEMENT <br />T~:IS AGREEMENT is made and entered into on the 10th day <br />of February, 1982, by and between LIVERMORE ACRES, a California <br />corporation, (hereinafter referred to as "Developer") and <br />the CITY OF PLEASAPdTON, a municipal corporation, (hereinafter <br />referred to as "City"). The City and Developer agree as set <br />forth below. <br />47 I T N E S S E T H <br />47HEREAS, Developer is the owner of real property in the <br />City of Pleasanton described in Exhibit "A", attached to <br />this agreement and made a part of it by this reference, <br />which consists generally of an approximately 35 acre site <br />located south of the Rosepointe subdivision and north of <br />Happy Valley P.oad, immediately westerly of Amber Lane; and <br />4JHEREAS, Developer has applied for and City has approved <br />a tentative subdivision of the property which would create <br />49 lots on the aforesaid property, said tract known as Tract <br />4372; and <br />47HEREAS, if Developer chose to install a sanitary sewer <br />lift station, dedicated to the City for maintenance and <br />operation, as part of the subdivision improvements, Condition <br />~~14 of the tentative map approval mandates that Developer <br />enter an agreement with City requiring Developer to provide <br />a maintenance fund for the sanitary sewer lift station for a <br />minimum ten year period; and <br />-1- <br />
