Jensen and Bobby J. Jensen, as Co-Trustees of the Jensen 1988 Living <br />Trust, John R. Jordan and Denva L. Jordan, Trustees of the John R. Jordan and Denva L. <br />Jordan Trust Agreement, dated 11/17/89, Roger J. Manning and Jane B. Manning, <br />Trustees of the Roger and Jane Manning Living Trust, dated June 3, 1998, and Manny <br />Del Arroz and Juanita Del Arroz (Property Owners) and the City of Pleasanton (City). <br />RECITALS <br />A. Property Owners own Lots 1 through 34, inclusive, Tract 7372, filed <br />_, 2003, in Map Book ,Pages ,Alameda County Records. <br />B. On September 17, 2002, Property Owners and City entered into a <br />Memorandum of Understanding (Pleasanton Golf Course) [hereafter MOU] in which <br />City agreed to purchase certain property from Property Owners (for a golf course and <br />open space) and City approved for the Property Owners a residential project of 371ots, 34 <br />new lots and three lots for existing and replacement homes. <br />C. The MOU also identifies certain infrastructure that the City intends to <br />construct, infrastructure that would benefit City property and the Property Owners' <br />property. <br />D. In the MOU, the Property Owners agree that they would pay their pro rata <br />share of the infrastructure (design and construction) costs allocable to their property. <br />E. The MOU also provides when the Property Owners are to pay their pro rata <br />share of the infrastructure. <br />F. The MOU also requires the Property Owners to pay at their sole expense all <br />standard development fees associated with the new 34 residential lots. <br />G. The parties now wish to memorialize those agreements in a recordable <br />document. <br />
