RN TO: RECORDED BY: PREANNEXATION AND PROVISION OF WATER FACILITIES AND SERVICE AGREEMENT THIS AGREEMENT is made and entered into this ~~~~ day of Q C~ ~ , 1998 by and between the City of Pleasanton, a municipal corporation (hereinafter referred to as "City") and Dominic and Diana Gaiero (hereinafter referred to as "Owner"), based on the following understandings: WITNESSETH: WHEREAS, Owner wishes to connect their residence located at X85 Happy Valley Road (949-0011-001-2) to the City water system; and WHEREAS, generally, City policy requires annexation prior to extension of such City services as water facilities; and WHEREAS, City, in accordance with State and LAFCo policies and regulations regarding annexation, either cannot or is unwilling to annex small portions of neighboring areas in piecemeal fashion, but may wish to annex such properties either alone or in conjunction with a larger area at some future time; and WHEREAS, City policy is adequately preserved through the provisions of an agreement wherein Owner consents to annexation to City at such time as City may require; and WHEREAS, City is willing to extend its water facilities only if there are assurances that the property won't be further subdivided or developed without approval of the City. NOW, THEREFORE, City and Owner hereby agree as follows: 1. Provision of Water Service. Owner may connect to City's water system upon execution of this Agreement prior to annexation of Owner's land. The connection shall be in accordance with the following: (a) Owner shall pay the then-existing water connection fee for connection to the water system in accordance with applicable City ordinances. annex\gaieragr.sam.ab
