AGREEMENT1 FOR INSTALLATIOPJ ANll MAIIITEIdAtJCE OF LANDSCAPING THIS AGREEMENT is made this 17th day of February , 1982 between FOOTHILL INVESTMENT GP.OUP, a joint venture , hereafter referred to as "Property Owner" and the CITY OF PLEASANTON, a municipal corporation, hereafter referred to as "City". R E C I T A L S THIS AGREEMENT IS BASED UFON THE FOLLO[4ING FACTS: (1) Property owner is the owner of real property in-the City of Pleasanton described in Exhibit "A", attached to this Agreement and made a part of it by this reference; (2) On July 16 1981 , the City granted a Design Review Board approval to said property; (3) By the terms of the Design Review Board approval, property owner is required to install and maintain landscaping in accordance with a plan, to be approved by the Planning Department prior to Build- ing Permit approval; (4) Both parties recognize that the installation and maintenance of landscaping is an integral part of the property owner's plan for development of the property. NOti9, THEREFORE, IT IS AGREED BETWEEN THE PARTIES, as follows: 1. Purpose. The purpose of this Agreement is to assure (a) installation in accordance with the landscaping plan previously approved by the City and (b) continued maintenance and care of the landscaping.
