.~ <br />AMENDED <br />• SUBDIVISION AGREEi•1ENT <br />TRACT NO. 5230 Fairlands, Unit 10 , PLEASAi<ITON <br />ALA~IEDA COUi]TY, CALIFORNIA <br />THIS AGREEi•IEI`JT made and entered at Pleasanton, California this <br />_ March 7, 1984 , by and between <br />First Pleasanton-Investors <br />3].123 Mission •Boulevard <br />Ilayward, CA 94544 _ <br />(hereinafter referred to as "Subdivider") and~Ditz--Crane, a California <br />Corporation, 2295 De La Cruz Boulevard, Santa Clara, CA 95050 as Assignee <br />and the City of Pleas<<nton,•a general law city, located-in Alameda <br />.County, Cali~forni~i , acting through the ~ C'ity' Mana.~xer` ' an3 the ~ City Clerk, <br />(hereinafter referred to as "City"). <br />~9FIEP.EAS, Subclividc~r has a tentative map for said tract, lying <br />within the boundaries of_ the City; duly approved by the Planning <br />Coramissian or the City Council; and <br />LrTIiF,RE.AS, all or a ~~ortion of the area of the tentative map is <br />presented as a "final map," a copy of said map is on file in .the <br />office of the City Engineer, and by reference is included in this <br />agreement for al.l purposes as if attached hereto; and <br />~•JHERk;AS, said map and subdivision of land designates streets, <br />easements and public ways for the City, and Subdivider proposes to <br />dedicate this land set forth in the final map to the City; and <br />WHERF;AS, as a cot~ditic.~n precedent to accepting this offer of <br />dedication by Subdivider, City requires the improvements of the public <br />ways, installation or extension of certain City services at Subdivider's <br />expense and certain protections for the City on behalf of the public. <br />W?IT;RFAS, subdivider intends to assign all rights and interest in the <br />property to Assignee upon final acquisition of the property. <br />NO~~, TIIEREFORE, in consideration of the faithful performance of <br />thE~ promises, terms, conditions and covenants set forth herein b~~ <br />Subdivider and the approval of the map for recording by the City <br />the parties hereto agree as follows: <br />1. Time of Essence. Time is of the essence in the performances <br />of this agreement. The work and improvements required by this agree- <br />ment to be completed by Subdivider shall be completed within one (1) <br />year from t}ie above-mentioned date of this agreement. <br />
