<br />Purchase Agreement for Water Line Easement <br />This Purchase Agreement (Agreement) is entered into this ~~ay of June 2000, by and <br />between the City of Pleasanton, a municipal corporation ("City") and John and Julie Finegan <br />("Property Owners"). <br />RECITALS <br />A. The Property Owners own real property commonly known as 5456 Hopkins <br />Court, Pleasanton, California (the "Property"). <br />B. The City desires to acquire a water line easement across a portion of the Property. <br />C. The Property Owners agree to sell to the City such an easement. <br />NOW, THEREFORE, in exchange for valuable consideration, the receipt of which is <br />hereby acknowledged, the parties agree as follows: <br />1. The Property Owners shall sell to the City an easement for the installation and <br />maintenance of a water line across the Property. Such easement shall be ten (10) feet in <br />width, and shall be located as shown on the attached Exhibit "A". <br />2. The Property Owners shall also grant the City a temporary construction easement to enter <br />onto limited areas of the Property as reasonably needed to install the water main within <br />the easement. Such temporary construction easement shall be valid until August 1, 2000. <br />3. The City shall pay the Property Owners two thousand dollars ($2,000.00) for the water <br />line easement. Such payment shall be made upon the Property Owners delivering to the <br />City an executed and recordable grant deed for the water line easement. Such grant of <br />easement shall be delivered to the City no later than July 1, 2000. <br />4. It is the intent of the City that the water pipeline to be installed within the easement will <br />be constructed within a steel casing, bored underneath the property. Hence, no <br />disturbance of the existing landscaping and trees within the easement is expected. The <br />City does agree, if the existing landscaping within the easement is disturbed or damaged <br />during construction of the water line, to replace or repair said disturbance/damage to a <br />state equal to that which existed prior to the construction work. The City also agrees to <br />replace or compensate owner (for a mutually agreeable amount) for any trees which may <br />die within the easement for a period of two years from the effective date of this easement. <br />5. This Agreement represents the entire understanding of the parties with regard to this <br />matter, and supercedes all prior oral and written agreements regarding this matter. <br />
