T <br />PLEASANTO:i, ALANLDA COUNTY, CALIFORNIA <br />THIS AGREEMENT made and entered at Pleasanton, California, <br />this JA,~~n~,~ 1'l+ l q~ b , by and between: <br />f6r~ . <br />b000 ~~rrph <br />Qtklaud 9, $tirli!'os'u1s <br />hereafter called "subdivider " and the <br />CITY OF PLEASANTON, a general law city, located <br />in Alameda County, California, acting through <br />the City Manager and the City Clerk, <br />hereafter called "City, is subject to the following terms, <br />covenants and conditions: <br />W I T N E S S E T H: <br />1. RECITALS. Subdivider has a tentative map for said <br />tract, lying withi~ ~he boundaries of the City, duly approved <br />by the Planning Commission or the City Council. All or a <br />portion of the area of the tentative map is presented as a <br />"final map's, is attached hereto as EXHIBIT A, and is made a <br />part of this agreement. Said map and subdivision of land <br />designates streets, easements and public ways for the City, <br />and subdivider proposes to dedicate this land set forth in the <br />final map to City. As a condition precedent to accepting this <br />offer of dedication by subdivider, City requires the improve <br />ments of the public ways, installation or extension of certain <br />City services at subdividex's expense and certain protections <br />for the City in behalf of the public. This agreement is <br />entered in consideration of thove premises by subdivider and <br />the approval of the map fir records.rg by the City. <br />2. TIME. Time is of the essence of th~.s agreement. <br />The ~n*ork and improvements req•.zired by this agreement shall be <br />completed by subdivider within one (1) year from the above <br />mentioned date of_ this agreement. The City rosy extend the <br />time for completion of improvements hereunder, upon good <br />cause being shown by the subdivider. Any such extension may <br />- 1 - <br />
