Ales <br />455 'den Way <br />Ple anton, CA 94566 <br />REIMBURSEMENT AGREEMENT <br />FOR SEWER IMPROVEMENTS <br />This Agreement ("Agreement") is entered into this ~ day of a d«i3C~~ <br />2001, by and between the CITY OF PLEASANTON, a municipal corporation ("City") <br />and PETER M. AND ROWENA E. ALES ("Owners"). <br />RF.C'TTAT.~ <br />A. Owners are the owners of certain real property located in the City of <br />Pleasanton, County of Alameda, State of California, commonly known as 455 Linden <br />Way ("Property"). <br />B. Owners have constructed a 6" inch sanitary sewer line along a portion of <br />Linden Way and Vine Street, a distance of approximately two hundred and twenty five <br />(225) linear feet ("Improvement"), as described more particularly in the attached Exhibit <br />"1 ", incorporated herein by this reference. <br />C. The Improvement contains supplemental size and capacity in order to benefit <br />the Owners and other anticipated development on nearby property. <br />D. Owners are entitled to reimbursement for that portion of the costs of the <br />Improvement, on a pro-rata basis, from any property which utilizes the Improvement. <br />NOW, THEREFORE, in exchange for mutual consideration, the receipt and value <br />of which is hereby acknowledged, the parties agree as follows: <br />Section 1. Improvement and Benefited Properties. <br />The Improvement to be constructed, financed, and installed by Owners benefits <br />other properties in addition to the Property ("Benefited Properties"). The Benefited <br />Properties are commonly known as APN 946-1708-1-1 and APN 946-1708-16-7, which <br />are two lots located on the southeast corner of Linden Way and Vine Street in Pleasanton, <br />and are more particularly described in the attached Exhibit "2". Owners are entitled to <br />recover the Reimbursable Cost of the Improvement from the property owner(s) of the <br />Benefited Properties. <br />
