. ~ • • <br />Recording requested by <br />and after recording return to: <br />Joseph and Beverly Ales <br />495 Linden Way <br />Pleasanton, CA 94566 <br />REIMBURSEMENT AGREEMENT <br />FOR SEWER IMPROVEMENTS <br />THIS AGREEMENT ("Agreement") is entered into this~~ day of)%e. , 1999, <br />by and between the CITY OF PLEASANTON, a municipal corporation ("City") and Joseph and <br />Beverly Ales. ("Owners"). <br />RECITALS <br />A. Owners are the owner of certain real property located in the City of Pleasanton, <br />County of Alameda, State of California, commonly known as 495 Linden Way ("Property"). <br />B. Owners received approval and have constructed a 6" inch sanitary sewer line from <br />Vineyard Avenue along Linden Way, a distance of 182.401inear feet ("Improvement"), as <br />described more particularly in the attached Exhibit "1 ", incorporated herein by this reference. <br />C. The Improvement contains supplemental size and capacity in order to benefit the <br />Owners and other anticipated development on nearby property. <br />D. Owners are entitled to reimbursement for that portion of the costs of the <br />Improvement, on a pro rata basis, from any property which utilizes the Improvement. <br />NOW, THEREFORE, in exchange for mutual consideration, the receipt and value of <br />which is hereby acknowledged, the parties agree as follows: <br />Section 1. Improvement and Benefited Property. <br />The Improvement benefits another property in addition to the Property ("Benefited <br />Property"). The Benefited Property is commonly known as 3581 Vineyard Avenue, Pleasanton, <br />and is more particularly described in the attached Exhibit "A". Owners are entitled to recover the <br />Reimbursable Cost of the Improvement from the property owner of the Benefited Property. <br />Section 2. Reimbursable Cost. <br />The City has reviewed the costs incurred by Owners for the construction of the <br />Improvement, which total $13,860 dollars. The Reimbursable Cost shall be $4,620 dollars. <br />
