~ ,. <br />~ ~ <br />CONTRACT <br />PROJECT NO. CIP 965020A <br />~~THIS CONTRACT is made and entered into this ~ day of <br />~~~~r~ 1997 by and between W.T. Cook Construction, Inc., <br />("Contractor"), and the CITY OF PLEASANTON, a municipal <br />corporation ("City"). <br />W I T N E S S E T H <br />WHEREAS, the City has awarded to the Contractor a contract <br />for St. John Emergency Vehicle Access Road, Project No. CIP <br />965020A. <br />NOW, THEREFORE, in consideration of the mutual promises set <br />forth herein, the parties agree as-:follows: <br />1. Work to be Performed. The work will generally consist of: <br />Demolition, grading and paving of access road within and <br />ad-iacent to Union Pacific Railroad including black vinyl <br />chainlink fence. Said work is more particularly shown <br />in the following documents which are on file with the <br />Department of Public Works of the City and are <br />incorporated herein by this reference: <br />A. Plans entitled the Emergency Vehicle Access Crossing, <br />St. John Street, Pleasanton and addenda <br />thereto, if any. <br />B. City of Pleasanton Standard Specification <br />C. Contract Change Orders approved by the City Engineer, <br />done in accordance with the Standard Specifications. <br />D. The proposal submitted to the City by the Contractor <br />dated February 28, 1997. <br />2. Compensation. The City shall pay the Contractor for work <br />actually performed at the unit prices set out in the <br />Contractor's proposal to the City. The quantities of work <br />stated therein are estimates only; actual quantities will be <br />measured for payment in accordance with the specifications. <br />3. Method of Payment. <br />A. Progress Payments. As of the twentieth day of each <br />month, Contractor may submit for review a request for <br />progress payment, listing the amount and value of work <br />actually performed during the preceding month, or part <br />thereof. Upon the City Engineer's review and approval, <br />including adjustments if any, City shall make a <br />progress payment to the Contractor. <br />
