,`~ Y WHEN RECORDED, R~RN TO: • RECORDED BY: <br />PREANNEXATION AND PROVISION OF WATER <br />FACILITIES AND SERVICE AGREEMENT <br />THIS AGREEMENT is made and entered into this 5th day of <br />-- April, 1994 by and between the City of Pleasanton, a municipal <br />corporation (hereinafter referred to as "City") and Bart Dickens <br />(hereinafter referred to as "Owner"), based on the following <br />understandings: <br />W I T N E S S E T H: <br />WHEREAS, Owner wishes to connect to the City Water system in <br />order to eliminate reliance on well water; and <br />WHEREAS, City policy requires annexation prior to extension of <br />such City services as water facilities; and <br />WHEREAS, City, in accordance with State and LAFCO policies and <br />regulations regarding annexation, either cannot or is unwilling to <br />annex small portions of neighboring areas in piecemeal fashion, but <br />may wish to annex such properties either alone or in conjunction <br />with a larger area at some future time, and <br />WHEREAS, the public health, safety, and welfare of the City's <br />residents as well as those in the neighboring community are best <br />served by elimination of inadequate well water and connection to <br />City water facilities; and <br />WHEREAS, City policy is adequately preserved through the <br />provisions of an agreement wherein Owner consents to annexation to <br />City at such time as City may require. <br />NOW, .THEREFORE, City and Owner hereby agree as follows: <br />1. Provision of Water Service. City agrees to allow Owner <br />to connect to City's water system upon execution of this Agreement <br />prior to annexation of Owner's land. Connection shall be in <br />accordance with the following: <br />(a) Owner agrees to pay the then-existing water <br />connection fee for connection to the water system <br />in accordance with applicable City ordinances. <br />(b) Owner agrees to pay all costs associated with <br />extension of the .water system to serve Owner's <br />
