(hereafter. called "City'.} <br />and FIRST PLEASANTON INVESTORS <br />1122 ..B.' Street <br />Hayward, California '94543 <br />is subject to 'the following terms .and conditions: <br />W I T N E S S E T H c <br />WHEREAS, Developer has been :the. owner of real graperty in the <br />City of Pleasanton, County of `Alameda, .State of .California, described <br />as follows: <br />Parcel 1 of Parcel Map 1.353 recorded February 11, 1974.:,..in <br />Map Book 83, Page 19`, Alameda County Records, said property <br />being commonly known as 3622 Santa Rita .Road, Pleasanton, <br />California, and designated as Parcel 16-1, <Alameda County <br />Asse sor's Map .Book 946, .Block 1100, containing :3.339 acres. <br />-AND WHEREAS, beveloper has =caused to be constructed a water <br />main extension in Santa Rita Road to the benefit of said real pro- <br />. - perty and. adjoining. property; and <br />WHEREAS,-pursuant to said Ordinance Code, Developer is enti led <br />to reimbursement for costs of said water main extensions and perimete r_ <br />.mains , and <br />,WHEREAS, Developer has caused or will cause to be .constructed <br />according to City standards and specifications those `facilities <br />delineated on EXHIBIT "A",attached hereto, and <br />~r7HEREAS,' City has inspected and accepted or will inspect and. <br />__ __ <br />accept said facilities together with necessary easements or rights- <br />of-way, and <br />WHEREAS, pursuant to an annexation agreement dated January 20, <br />1964, the period of time for reimbursement for off-:tract improvements <br />sha11 be extended- to fifteen (15} years and a current interest <br />factor shall be applied to .the amount to be subject to reimbursement. <br />
