~'1 <br />• f' ~ y <br />REIMBURSEMENT l-(iREEMENT <br />TH1S AGREEMENT entered into at Pleasanton, California this <br />(v day of ~l•dY 1986, by and between <br />the CITY OF PLEASANTON, a general law city, located in Alameda <br />County, California (.hereinafter referred to as "City"), and RALPH <br />ROMERO, JR. and SHARON K. ROMERO, husband and wife of 2800 <br />Foothill Road, Pleasanton, California, KRISTEN J. LAMB of 2982 <br />Foothill Road, Pleasanton, California and DIANE MARTIN, as <br />Executrix of the ESTATE OF VASSALLO of 38674 Chrisholm Place, <br />Fremont, California (hereinafter collectively referred to as <br />"Developer" or "Developers") subject to the following terms and <br />conditions: <br />R E C I T A L S <br />A. Each Developer is the owner of a parcel of real property in <br />the City of Pleasanton, County of Alameda, State of California, <br />as shown on. Exhibit "A" attached hereto and fully incorporated by <br />reference herein. <br />B. Each of the Developers has an approved tentative map on its <br />property. (LAMB, APN 946-3930-2, MS 85-04), (ESTATE OF VASSALLO, <br />APN 946-3930-6, MS 85-18), (ROMERO, APN 946-3930-10-2, MS 84-10). <br />The City conditioned each of the three minor subdivision <br />approvals just referenced with a requirement that the subdividers <br />enter into a Deferred Street Improvement Agreement with the City <br />to pay its fair share of Foothill Road improvements as deemed <br />necessary by the City. <br />C. ROMERO is ready to proceed with subdivision of its parcel. <br />The City is requiring that ROMERO bond for and construct a 791 <br />foot segment of eight (8) inch sewer line as indicated on Exhibit <br />"A". <br />D. The first 610 feet of sewer line (designated as the'- <br />"Reimbursable Project" on ,Exhibit "A") is of a'supplemental size <br />and length which. benefits a number of neighboring properties <br />(designated as the "Benefit Area" on Exhibit "A"j. <br />E. The four remaining property owners within the Benefit Area <br />are CERRUTTI (APN 946-3930-7), OLESEN (APN 946-3930-4-2 and APN <br />946-3930-4-1), GARTUNG (APN 946-3930-5-4), and STEVENSEN (APN <br />946-3930-5-1). The GARTUNG, STEVENSEN and OLESEN properties are <br />not yet within the incorporated city limits of the City. <br />F. Pursuant to the Subdivision Map Act, the City is required to <br />make reasonable arrangements toyprovide for reimbursement when <br />initial developers provide disportionately supplemental size and <br />length for utility~'extensions. <br />- 1 - <br />
