r. <br />~ ~ <br />REIMBURSEMENT AGREEMENT FOR <br />OFF-SITE TRAFFIC SIGNAL CONDUIT IMPROVEMENTS - TRACT 6266 <br />THIS AGREEMENT is entered into at Pleasanton, California, <br />this day of September, 1991, by and between CITY OF <br />PLEASANTON, Alameda County, California, a municipal corporation <br />("City") and AIIlKANSON DEVELOPMENTS INC. ("Developer") with. <br />reference to the following facts. <br />A. Developer is the owner of certain real property in the. <br />City of Pleasanton, County of Alameda, State of California, <br />commonly known as Tract 6266 (the "Property"). Developer has <br />obtained City approval of a subdivision map for a 136 lot <br />residential subdivision. <br />B. In connection with subdivision described above, <br />Developer intends to construct or cause to be constructed certain <br />public improvements off-site. As part of the off-site <br />improvements a joint trench must be dug by Developer along <br />Foothill and Bernal Avenue. The City Engineer has requested and <br />the developer has agreed to include a 3" conduit in the joint <br />trench for the City's traffic signal interconnect system. <br />C. Pursuant to the Subdivision Map Act (California <br />Government Code, Sec. 66410 et se .), Developer is entitled to <br />reimbursement for certain costs of the improvements referred to <br />above. City will accept said improvements and is willing to <br />reimburse the Developer for the cost as set forth herein. <br />NOW, THEREFORE, IT IS AGREED AS FOLLOWS: <br />1. Improvements. <br />a. Certain construction work subject to reimbursement <br />to be performed by Developer as shown on approved construction <br />plans, consisting of the .approximately 4350 lineal feet of 3 inch <br />conduit with pull rope cable in a joint trench on Foothill Road <br />from Bernal Avenue to Racoon Hollow Court and related public <br />improvements, will benefit the City. Developer is entitled to <br />recover the costs of such construction work from the City for <br />these improvements. The construction work to be performed by <br />Developer for the off-site improvements eligible for <br />reimbursement hereunder (collectively, the "Improvements") shall <br />include the work described on Exhibit "A" hereto which shall be <br />performed at an estimated cost as shown thereon. <br />b. The reimbursement fee shall be based upon the <br />construction cost estimate of $20,857.31, as stated in Exhibit <br />"A". Within 60 days after completion of the job, Developer shall <br />submit actual costs of the construction work, to the City <br />Engineer. Thereafter, reimbursement fees shall be based upon <br />actual costs which shall not exceed ten percent (10%) of the <br />estimated cost of $20,.857.31, unless the increase over ten <br />percent (10%) of the costs is approved by the City Engineer. <br />-1- <br />
