AHMANSON DEVELOPMENTS REIMBURSEMENT OFFSITE SIGNAL IMPROVEMENTS

r. ~ ~ REIMBURSEMENT AGREEMENT FOR OFF-SITE TRAFFIC SIGNAL CONDUIT IMPROVEMENTS - TRACT 6266 THIS AGREEMENT is entered into at Pleasanton, California, this day of September, 1991, by and between CITY OF PLEASANTON, Alameda County, California, a municipal corporation ("City") and AIIlKANSON DEVELOPMENTS INC. ("Developer") with. reference to the following facts. A. Developer is the owner of certain real property in the. City of Pleasanton, County of Alameda, State of California, commonly known as Tract 6266 (the "Property"). Developer has obtained City approval of a subdivision map for a 136 lot residential subdivision. B. In connection with subdivision described above, Developer intends to construct or cause to be constructed certain public improvements off-site. As part of the off-site improvements a joint trench must be dug by Developer along Foothill and Bernal Avenue. The City Engineer has requested and the developer has agreed to include a 3" conduit in the joint trench for the City's traffic signal interconnect system. C. Pursuant to the Subdivision Map Act (California Government Code, Sec. 66410 et se .), Developer is entitled to reimbursement for certain costs of the improvements referred to above. City will accept said improvements and is willing to reimburse the Developer for the cost as set forth herein. NOW, THEREFORE, IT IS AGREED AS FOLLOWS: 1. Improvements. a. Certain construction work subject to reimbursement to be performed by Developer as shown on approved construction plans, consisting of the .approximately 4350 lineal feet of 3 inch conduit with pull rope cable in a joint trench on Foothill Road from Bernal Avenue to Racoon Hollow Court and related public improvements, will benefit the City. Developer is entitled to recover the costs of such construction work from the City for these improvements. The construction work to be performed by Developer for the off-site improvements eligible for reimbursement hereunder (collectively, the "Improvements") shall include the work described on Exhibit "A" hereto which shall be performed at an estimated cost as shown thereon. b. The reimbursement fee shall be based upon the construction cost estimate of $20,857.31, as stated in Exhibit "A". Within 60 days after completion of the job, Developer shall submit actual costs of the construction work, to the City Engineer. Thereafter, reimbursement fees shall be based upon actual costs which shall not exceed ten percent (10%) of the estimated cost of $20,.857.31, unless the increase over ten percent (10%) of the costs is approved by the City Engineer. -1-
