~ ~ <br />w <br />.,~^' • <br />REIMBURSEMENT AGREEMENT FOR <br />STRUCTURAL PLAN CHECK - STONERIDGE DRIVE BRIDGE <br />THIS AGREEMENT is entered into at Pleasanton, California, this ,~ day of ~~~` <br />1996 by and between the CITY OF PLEASANTON, Alameda County, California, a municipal <br />corporation ("City") and Kaufman and Broad, South Bay, Inc.("Developer/Applicant") with <br />reference to the following facts. <br />A. Developer/Applicant has the an Option to Purchase a portion of the certain real <br />property in the City of Pleasanton, County of Alameda, State of California, commonly known as <br />Staples Ranch Development, owned by Alameda County (the "Property"). Developer is seeking <br />City approval of asingle-family residential project to be constructed on the Property. <br />B. In connection with. construction described above, Developer/Applicant is required <br />to extend Stoneridge Drive by building a bridge over the Arroyo Mocho ("Stoneridge Drive <br />Bridge"). <br />C. City desires to contract with Peoples Associates fora structural plan check of <br />the plans and specifications for the proposed Stoneridge Drive Bridge. <br />NOW, THEREFORE, IT IS AGREED AS FOLLOWS: <br />1. Work Developer is requested to extend Stoneridge Drive by building a bridge <br />over the Arroyo Mocho, per plans and specifications approved by the City Engineer. As part of <br />the City's review process, City desires to contract directly with a consultants to complete a <br />structural plan check of the Stoneridge Drive Bridge plans and specifications. <br />2. Reimbursement. Developer/Applicant agree to reimburse City for all costs for all <br />work described in Paragraph 1 above. No overhead shall be charged by the City. Developer <br />shall make payment to the City within thirty (30) days after the receipt of invoices from City. If <br />payment is not received, the work as stated in Paragraph 1 shall be suspended until compensation <br />is received. <br />3. Amount. Developer/Applicant shall pay the City a total amount not to <br />exceed $11,820.00 for the work described in Paragraph 1. <br />4. Term. This agreement shall remain in effect until such time as the Stoneridge <br />Drive Bridge is completed and accepted by the City. <br />5. Compliance with Laws. The Developer/Applicant shall comply with all <br />applicable federal, state, and municipal laws, rules, and ordinances. No discrimination shall be <br />made by the Developer/Applicant in the employment of persons to work under this contract <br />because of race, color, national origin, ancestry, sex or religion of such person. <br />
