BEST as Trustee of the Best Intervivos Trust (hereinafter <br />referred: to an "Landowner"). <br />R E C I T A L S <br />A. Landowner owns a 3.73 acre parcel. at the southwest corner <br />of Valley Avenue and Boulder. Street (A.P.N. 946-1251-12} (here- <br />after "the .Property"). <br />B. Lando~,rner has applied to City for approval tosubdivde <br />property into two parcels, 1.68 ~.nd 2.05 acres. each (MS-84-23). <br />C. City has applied to the Calitornia_Public Utilities <br />Commission for approval of the Va11ey Avenue Extension Project <br />(P. L'. C. Application No. 83-12-39). <br />D. The Valley Avenue Extens-ion Project consists of three <br />public street crossings of the existing railroad tracks including <br />the extension of Valley Avenue to connect with Stanley Boulevard,, <br />and upgrading .the Busch Road conr_ection to ~Ta11ey Avenue to :become <br />a public rather than private crossing. <br />F.. The Property is within the urea which will specially <br />b~nerit from the proposed Valley Avenue Extension Project, and <br />the '=sects of 115-84-23 will be mitigated by completion: of the <br />Valley avenue Extension Project. <br />NOt9, THEREFORE, in consideration of the faithful performance <br />of the terms, conditions, covenants and .promises set forth herein, <br />the parties hereto agree. as follows: <br />
