PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC-2006-24 <br />RESOLUTION APPROVING A CONDITIONAL USE PERMIT FOR SHERRI SWEETNAM/ <br />JAZZ-N-TAPS DANCE STUDIO, AS FILED UNDER CASE PCUP-167 <br />WHEREAS, Sherri Sweetnam/Jazz-N-Taps Dance Studio, has applied for a conditional use <br />permit to operate a dance studio within the existing building located at <br />3930 Valley Avenue, in the Valley Business Park; and <br />WHEREAS, zoning for the property is PUD--I (Planned Unit Development -Industrial) <br />District; and <br />WHEREAS, at its duly noticed public hearing of May 10, 2006, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application; and <br />WHEREAS, projects of this nature are categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA); and <br />WHEREAS, the Planning Commission made the following findings: <br />The proposed location of the conditional use is in accordance with the <br />objectives of the zoning ordinance and the purpose of the district in which <br />the site is located. <br />The general provisions of the Zoning Ordinance state that part of the objectives of <br />the ordinance are to foster a harmonious, convenient, workable relationship <br />among land uses, protect existing land uses from inharmonious influences, and to <br />ensure that public and private lands ultimately are used for the purposes which are <br />the most appropriate and beneficial to the City as a whole. As conditioned, the <br />proposed use would be consistent with these objectives. <br />The subject building is located in Valley Business Park, which is located in a <br />Planned Unit Development Industrial (PUD-I) District and is intended to provide <br />sites for industrial uses, neighborhood and support commercial uses, and office <br />uses. Given the small scale of the operation and its location, the proposed use <br />would be compatible with surrounding uses. As proposed there would be eight <br />part-time employees with no more than two employees working at the dance <br />studio at any given time; there will be up to ten students attending each class, and <br />the majority of the classes are conducted after regular business hours. For these <br />reasons, the use would not create parking or circulation impacts, and this finding <br />can be made. <br />
