6 <br />ORDINANCE NO. 1960 <br />AN ORDINANCE APPROVING THE APPLICATION OF JEREMY AND JOSIE <br />GARNISH FOR A PUD MAJOR MODIFICATION AND DEVELOPMENT PLAN, <br />AS FILED UNDER CASE PUD-99-01-04M <br />WHEREAS, Jeremy and Josie Barnish have applied for a PUD major <br />modification to an approved PUD development plan to allow an existing solid fence to <br />remain, where open fencing is required, along a portion of the rear and side property <br />lines of the property located at 4526 River Rock Hill Road and to modify Condition of <br />Approval No. 6 of Ordinance No. 1918 (PUD-9-01-3M), adopted on June 21, 2005, such <br />that requests for solid fencing may be approved by the Zoning Administrator; and <br />WHEREAS, zoning for the property is PUD-RDR/LDR (Planned Unit <br />Development -Rural Density Residential/Low Density Residential) District; and <br />WHEREAS, the construction and location of accessory structures, including <br />garages, carports, patios, swimming pools, and fences, are categorically exempt <br />(Section 15303) from the requirements of the California Environmental Quality <br />Act (CEQA); and <br />WHEREAS, the City Council received the Planning Commission's positive <br />recommendations for approval of the PUD major modification for the subject site; and <br />WHEREAS, the City Council finds that the PUD major modification and <br />development plan are consistent with the General Plan policies and the purposes of <br />the PUD ordinance of the City of Pleasanton. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />DOES HEREBY ORDAIN AS FOLLOWS: <br />SECTION 1. Approves Case PUD-99-01-04M, the application of Jeremy and <br />Josie Barnish for a PUD major modification to an approved PUD development <br />plan to allow an existing solid fence to remain, where open fencing is required, <br />along a portion of the rear and side property lines of the property located at <br />4526 River Rock Hill Road and to modify Condition of Approval No. 6 of <br />Ordinance No. 1918 (PUD-9-01-3M), adopted on June 21, 2005, such that <br />requests for solid fencing may be approved by the Zoning Administrator, subject <br />to the conditions shown on Exhibit B, attached hereto and incorporated herein by <br />this reference. <br />SECTION 2. A summary of this ordinance shall be published once within <br />fifteen (15) days after its adoption in "The Valley Times," a newspaper of general <br />circulation published in the City of Pleasanton, and the complete ordinance shall <br />be posted for fifteen (15) days in the City Clerk's office within fifteen (15) days <br />after its adoption. <br />
