MINUTES OF THE MEETING OF THE PLEASANTON CITY COUNCIL April 6, 2004 6:00 P.M. CLOSED SESSION Conference with legal counsel regarding pending litigation (Signature Properties, et al. v. Pleasanton Unified School District) Conference with legal counsel regarding potential litigation involving Signature Properties concerning the Vineyard Avenue Roadway Improvements, PUD Conditions for the Ruby Hill Project and acceptance of public improvements within the Ruby Hill Subdivision. CALL TO ORDER The regular meeting of thc City Council was called to order by Mayor Tom Pico at 7:13 p.m. Councilmember Ayala led the assemblyin the pledge of allegiance. She mentioned that she had received requests from members of the public asking Council to reconsider its decision it made on the water park. She asked legal counsel to explain and clarify why Council could not reconsider its decision on the water park. Michael Roush, City Attorney, did not believe it would be within the Council's purview to reconsider its decision. Unlike legislative decisions, this decision stands upon its adoption. Ms. Ayala thanked the residents for sharing their concerns about the water slides since Council's last meeting. The project was scaled down considerably, and the developer will be forming an oversight committee comprised of Pleasanton residents to ensure that the project ends up being an activity that enhances Pleasanton. The BMX course will be built this summer. She reminded everyone that the amateur competition for the Bemal Design Competition is in its second briefing and the site visit will occur on April 14 with the deadline to register on May 1. She encouraged amateur designers to be part of this competition. She noted that some of the downtown Pleasanton businesses held a Spring Carnival on First Street.
