41,3 <br /> <br /> MINUTES <br /> of <br /> THE MEETING <br /> of <br /> THE CITY COUNCIL <br /> <br /> May 17, 1976 <br /> <br />CALL TO ORDER <br /> Mayor Robert Philcox called the Adjourned Regular Meeting of the City Council <br /> to order at 7:00 P.M. <br /> <br />ROLL CALL <br /> Councilmembers Brandes, Herlihy, LeClaire, Mercer, and Mayor Philcox were promant. <br />Mr. Edgar, City Manager, was present. Mr. Scheidig, City Attorney, was also present. <br /> <br />SPECIAL REPORTS <br />Approval of Subdivision Agreement, Tract 3344~ He~i~a~e Valley <br /> Mr. Edgar presented the report of the Director of Engineering Services dated <br />May 12, 1976, regarding this matter. <br /> <br /> It was moved by Councilmember Brandes, and seconded by Councilmember Herlihy, <br />that Resolution No. 76-116, approving the Subdivision Agreement with Morrison Homes, <br />Inc., regarding Phase I of Tract 3344, Heritage Valley, Unit No. 2, and authorizing <br />execution of the Agreement by the appropriate City officials, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Herlihy, LoCiairs, Mercer, and Mayor Philcox <br />NOES: None <br />ABSENT: None <br /> <br />Review of Bids and Award of Contract on Val Vista Park Tot Lot and Picnic Areas <br /> Mr. Edgar presented the report of the Director of Engineering Services dated <br />May 11, 1976, regarding this matter. <br /> <br /> It was moved by Councilmember LeClaire, and seconded by Councilmember Mercer, <br />that Resolution No. 76-117, awarding contract in the amount of $17,347.00, to Pacific <br />Landscape, Inc., 180 Thorup Lane, San Ramon, for improvements to Val Vista Park Tot <br />Lot and Picnic Areas, State Project No. 01-0015, less the play equipment, and auth- <br />orizing execution of the Contract by the appropriate City officials, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Herlihy, LoCiairs, Mercer, and Mayor Philcox <br />NOES: None <br />ABSENT: None <br /> <br />MATTERS INITIATED BY COUNCIL MEMBERS <br />William Thompson Seat on Housin~ Authority Board <br /> Council discussion ensued regarding the seat of William Thompson on the Housing <br />Authority Board. <br /> <br /> It was moved by Councilmember Brandes, and seconded by Councilmember Herlihy, <br />that the City Jointly request an opinion of the State Attorney General as to the <br />legality of Mr. Thompson retaining his seat on the Housing Authority Board. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Herlihy, Mercer, and Mayor Philcox <br />NOES: Councilmember LeClaire <br />ABSENT: None <br /> <br /> It was also the consensus of the City Council, with Councilmember LeClatre <br />dissenting, that Mr. Thompson would retain his seat on the Housing Authority <br />Board until the Attorney General's opinion has been issued. <br /> <br />Notification of Proper.F~ Owners Re~ard.ing Various Planning Matters <br /> The City Manager was asked to review with the Planning Director the question <br />of notification of property owners regarding the various planning cases that are <br />heard at the Planning Commission level. <br /> <br /> <br />
