MINUTES <br /> of <br /> THE ~IEETING <br /> of <br /> THE CITY COUNCIL <br /> <br /> March 1, 1978 <br /> <br />CALL TO ORDER - PLEDGE TO THE FLAG <br /> Mayor Robert Philcox called the Continued Regular Meeting of the City Council <br />to order at 8:00 P.M., and then led the Pledge of Allegiance to the flag. <br /> <br />ROLL CALL <br /> Deputy City Clerk Doris George called the roll which is recorded as follows: <br />Councilmembers Brandes, Herlihy, LeClaire, Mercer, and Mayor Philcox were present. <br />Mr. Brown, City Manager, Mr. Levine, City Attorney, Mr. Harris, Director of <br />Planning and Community Development, and Mr. Swift, Planning Analyst, were present. <br /> <br />PUBLIC }tF~LRINGS (Contd.) <br />Appeal of Robert J. Myers to a decision of the Planning Commission. denyi~8 <br />PUD-77-7, ~n application for a planned unit development to rezone a 12.7 acre <br />site located innnediately south of the terminus of Las Lomitas Drive and east <br />of the Pleasanton School from the A (ASricultural) District to the PUD (Planned <br />Unit Development Medium Density Residential) District and to approve a develop-. <br />ment plan for the site consistin5 of a llg-unit limited care retiF~ent facility <br /> Mayor Philcox stated that the public hearing on the appeal of Robert J. Myers <br />was continued open from the meeting of February 28, 1978, for additional testi- <br />mony on this matter. <br /> <br /> The following persons spoke in opposition to the appeal and location of the <br />application: <br /> <br /> Mrs. Shirley Lutz, 581 E. Angela Street, continued reading a letter <br /> from L. B. Pereira, 43 Golf Road, in opposition to the location <br /> of the proposed facility. Mrs. Lutz also voiced her opposition <br /> to the application. <br /> <br /> Dr. Max Biggs, 4616 Las Lomitas Drive <br /> Roy Niedt, 4500 Mirador Drive <br /> Dorothy Reid, 4525 Mirador Drive <br /> <br /> Mr. Hirst rebutted the testimony presented by the pponents. He also sub- <br />mitted as evidence a letter from Kenneth M. Levy, Levy and Waldman, Law Cor- <br />poration, Suite 600, Alcoa Building, Maritime Plaza, San Francisco, relating <br />to HUD regulations of such projects. <br /> <br /> Mr. Charles Mullen, 1600 B Street, Hayward, Architect for the proposed <br />facility, elaborated on solutions to the concerns voiced by the opponents. <br /> <br /> Mr. Hirst closed his rebuttal by reiterating the need for this facility <br />in Pleasanton and the merits of the proposal, and requested favorable considera- <br />tion of the PUD Zoning and also further discussion regarding modifications. <br /> <br /> Mr. Mullen briefed the Council on the proposed second phase - 50 bed wing. <br />Mr. Harris stated the addition would place this project in the high density <br />category. <br /> <br /> <br />
