MINUTES <br /> of <br /> THE MEETING <br /> of <br /> THE CITY COUNCIL <br /> <br /> April 21, 1980 <br /> <br />CALL TO ORDER <br /> Mayor Kenneth Mercer called the Special Meeting of the City Council to order <br />at 7:30 P.M., at the City Hall Conference Room. <br /> <br />ROLL CALL <br /> The roll call is recorded as follows: Councilmembers Butler, Mohr, and Mayor <br />Mercer were present. Councilmembers Kephart and Wood were absent. Mr. Walker, <br />City Manager, and Mr. Levine, City Attorney, were present. <br /> <br />EXECUTIVE SESSION <br /> Mayor Mercer recessed the meeting at 7:35 P.M., to an Executive Session to <br />discuss litigation. <br /> <br /> Mayor Mercer reconvened the meeting at 8:00 P.M. <br /> <br /> It was moved by Councilmember Butler, and seconded by Councilmember Mohr, that <br />Resolution No. 80-87, authorizing the Mayor to execute the Waiver and Compromise <br />Agreement signed by the developers relative to the settlement of motion to compel <br />relating to claims for sewer capacity under the 1972 Settlement Agreement, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Mohr, and Mayor Mercer <br />NOES: None <br />ABSENT: Councilmembers Kephart and Wood <br /> <br /> It was moved by Councilmember Butler, and seconded by Councilmember Mohr, that <br />Resolution No. 80-88, authorizing the City Attorney's office to respond to any appeal <br />filed by the District in this matter, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Mohr, amd Mayor Mercer <br />NOES: None <br />ABSENT: Councilmembers Kephart and Wood <br /> <br />ADJOURNMENT <br /> There being no further business at 8:05 P.M., Mayor Mercer adjourned the SpeCial <br />Meeting, to meet again in Regular Session on April 22, 1980, 8:00 P.M., at the Fair- <br />grounds Cafeteria. <br /> <br />Respectfully submitted, <br /> <br />J S R.
