MINUTES <br /> of <br /> THE MEETING <br /> of <br /> THE CITY COUNCIL <br /> <br /> February 6, 1981 <br /> <br /> CALL TO ORDER <br /> Mayor Kenneth Mercer called the Special Meeting of the City Council to order <br />at 5:30 P.M., at the Cultural Arts Building. <br /> <br />ROLL CALL <br /> The roll call is recorded as follows: Councilmembers Butler, Kephart, Mohr, <br />Wood, and Mayor Mercer were present. Mr. Walker, City Manager, and Mr. Levine, <br />City Attorney, were present. <br /> <br /> Mayor Mercer stated that the only item on the agenda is discussion of the <br />Gravel Truck Ordinance. He asked if anyone in the audience would like to address <br />the Council. <br /> <br /> Mr. Dale Turner, Mayor of Livermore, asked to speak to the Council. Mayor <br />Turner said that the Livemore City Council met in Executive Session this morning <br />(2-6-81), to discuss their plans to file suit against the City of Pleasanton. The <br />Livemore City Council decided to withdraw from the suit as plaintiffs, and asked <br />the City of Pleasanton City Council to delay enactment of the Weight Limitation <br />Ordinance for 120 days to give them a chance to consider whether to enact a similar <br />type ordinance that would relate to gravel trucks using certain city streets. <br /> <br /> Councilmember Wood asked if 120 days would be sufficient time. Mayor Turner <br />stated that he thought 120 days might be a little more than was needed, however, <br />additional time might also be required <br /> <br /> It was moved by Councilmember Kephart, and seconded by Councilmember Butler, <br />that Ordinance No. 960, to be read by title only and waiving further reading <br />thereof, amending Ordinance No. 954, Section2(Effective Date) to change the date <br />to June 26, 1981, be adopted as an urgency measure. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Kephart, Mohr, Wood, and Mayor Mercer <br />NOES: None <br />ABSENT: None <br /> <br /> Councilmember Butler stated that whenMayor Turner had made a similar request <br />at the January 27, 1981, Council meeting that hew as not aware of the reasons that <br />Livemore was asking for the delay and therefore voted against the delay at that <br />time. <br /> <br /> Mayor Mercer stated that he would like to make a few comments concerning some <br />of the statements that had been reported by the press, to Mayor Turner. He said <br />that the gravel truck issue and the planned suit by Livemore against Pleasanton. <br />was an emotional issue and, therefore some statements that had been made were <br />unfortunate. He stated that Mayor Turner had been his friend for nine years and <br />he did not want the press statements to effect that friendship, and he would like <br />to make a public apology. Mayor Turner stated he felt the same way and would also <br />like to apologize to Mayor Mercer. <br /> <br /> <br />
