MINUTES <br /> OF THE <br /> SPECIAL MEETING <br /> OF <br /> THE CITY COUNCIL <br /> <br /> January 15, 1997 <br /> <br />1. CALL TO ORDER <br /> <br /> Mayor Ben Tarver called the Special Meeting of the City Council to order at 7:30 a.m. <br />Councilmembers present were Kay Ayala, Becky Dennis, Thomas P. Pico, Jr., and Mayor Ben <br />Tarver. Staff members present were: Deborah Acosta, City Manager; Michael H. Roush, City <br />Attorney; Randall A. Lum, Director of Public Works; and Steve Cusenza, Deputy Director of <br />Utilities. <br /> <br /> Councilmember Michelotti was absent and excused. <br /> <br />2. CLOSED SESSION <br /> <br /> Mr. Roush announced that the purpose of the special meeting was to meet with legal <br />counsel to discuss in closed session potential litigation against DERWA regarding its San Ramon <br />Valley recycled water program/EIR. <br /> <br /> Before adjouming to closed session, the Mayor asked if anyone wished to address the <br />City Council on this matter. <br /> <br /> Carl Morrison, appearing as a private individual, asked to be heard. He said that <br />although he is a consultant to DSRSD and DERWA, he was appearing today as a private citizen. <br />He indicated his belief that Council's real concerns were with issues concerning LAVWMA <br />rather than with the DERWA project. He believed that the DERWA project had nothing to do <br />with LAVWMA. He felt that if the Council chose not to file suit, it would go a long way in <br />facilitating discussions with LAVWMA <br /> <br /> The Mayor thanked Mr. Morrison for his comments. <br /> <br /> The Council then adjourned to closed session. <br /> <br /> Page 1 <br /> 01/15/97 <br /> <br /> <br />
