THE CITY OF <br />j~L£~S~4NTONo <br />CITY COUNCIL AGENDA REPORT <br />8 <br />September 18, 2007 <br />Public Works Department <br />TITLE: CONSIDER A PREDEVELOPMENT AND COOPERATION AGREEMENT <br />BETWEEN THE CITIES OF LIVERMORE, PLEASANTON, THE COUNTY <br />ALAMEDA, THE ALAMEDA COUNTY SURPLUS PROPERTY AUTHORITY <br />AND CALMAT CO., DBA VULCAN MATERIALS AND A COST SHARING <br />AGREEMENT BETWEEN THE CITIES OF LIVERMORE, PLEASANTON <br />AND THE ALAMEDA COUNTY SURPLUS PROPERTY AUTHORITY <br />CONCERNING THE STAPLES RANCH PROPERTY <br />SUMMARY <br />Attached is a Cost Sharing Agreement between the Cities of Livermore, Pleasanton, <br />and the Alameda County Surplus Authority, and aPre-Development and Cooperation <br />Agreement between the Cities of Livermore, and Pleasanton, the County of Alameda, <br />Alameda County Surplus Property Authority (SPA), and Vulcan Materials (Vulcan), <br />which operates the quarries south of the Staples Ranch property. Each of these parties <br />have economic, regulatory or ownership interests in land within, or adjacent to, Staples <br />Ranch and will therefore share, to various degrees, in the benefits and responsibilities <br />of constructing and maintaining public improvements in the area. The agreements <br />establish financial responsibility, design responsibility and parameters, construction <br />timing and long term rights as they relate to the design and construction of EI Charro <br />Road and mitigation of storm water issues. The agreements do not obligate Pleasanton <br />to approve improvements proposed for the Staples Ranch development or alter financial <br />assumptions made in the Staples Ranch MOU, but rather, establish the scope of <br />improvements required and the method of payment in the event development is <br />approved. <br />RECOMMENDATION <br />Staff recommends that the City Council approve the attached two resolutions <br />authorizing the City Manager to execute the agreements. <br />FINANCIAL STATEMENT <br />Approval of the agreements establish financial obligations for roadway and storm water <br />improvements included in the Staples Ranch MOU including a $1 million reimbursement <br />to the City of Pleasanton from the City of Livermore towards the I-580/ EI Charro Road <br />interchange improvements. <br />
