<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-2007-23 <br /> <br />RESOLUTION APPROVING A CONDITIONAL USE PERMIT FOR BARNABAS NAGY, <br />AS FILED UNDER CASE PCUP-182 <br /> <br />WHEREAS, Barnabas Nagy has applied for a conditional use permit to allow alcoholic <br />beverage service after 10:00 p.m. at the restaurant to be located at <br />2001 Ruby Hill Boulevard; and <br /> <br />WHEREAS, zoning for the property is PUD/OS/A/LDR (Planned Unit Development – <br />Open Space/Agriculture/Low Density Residential) District; and <br /> <br />WHEREAS, at its duly noticed public hearing of May 9, 2007, the Planning <br />Commission considered all public testimony, relevant exhibits, and <br />recommendations of the City staff concerning this application; and <br /> <br />WHEREAS, at its meeting of May 9, 2007, the Planning Commission recommended <br />approval of the Initial Study and Negative Declaration prepared for the <br />project; and <br /> <br />WHEREAS, the Planning Commission made the following findings: <br /> <br />1. The proposed location of the conditional use is in accordance with the objectives <br />of the zoning ordinance and the purpose of the district in which the site is <br />located. <br /> <br />The proposed project, as designed and conditioned, meets all applicable City standards <br />concerning public health, safety, and welfare, e.g., vehicle access, geologic hazards <br />(new development not within a special studies zone), and flood hazards. The proposed <br />development plan is designed in conformance with the Pleasanton General Plan <br />designations for this site and all other relevant policies and programs. The applicant will <br />be required to install a left-turn pocket and on Vineyard Avenue to facilitate efficient <br />access to the site for westbound traffic and a deceleration lane on Vineyard Avenue. As <br />proposed, there would be a total of 100 parking spaces provided in the parking area, <br />which will adequately meet the event and daily parking demand. The number of <br />proposed parking spaces greatly exceeds the number of spaces required by the <br />Pleasanton Municipal Code. <br /> <br /> <br />
