<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-2007-22 <br /> <br />RESOLUTION RECOMMENDING APPROVAL OF THE APPLICATION OF <br />BARNABAS NAGY FOR A MAJOR MODIFICATION, <br />AS FILED UNDER CASE PUD-93-02-09M <br /> <br />WHEREAS, Barnabas Nagy has applied for a major modification to the Ruby Hill PUD <br />development plan to: (1) relocate the existing sales office building on <br />Ruby Hill Boulevard northwesterly along Vineyard Avenue; (2) change the <br />existing office use to restaurant use; (3) revise the configuration of the <br />existing parking lot; (4) establish a new driveway off of Vineyard Avenue; <br />and (5) establish a pad location and design guidelines for a future <br />single-family residence at the property located at 2001 Ruby Hill <br />Boulevard; and <br /> <br />WHEREAS, zoning for the property is PUD/OS/A/LDR (Planned Unit Development – <br />Open Space/Agriculture/Low Density Residential) District; and <br /> <br />WHEREAS, at its duly noticed public hearing of May 9, 2007, the Planning <br />Commission considered all public testimony, relevant exhibits, and <br />recommendations of the City staff concerning this application; and <br /> <br />WHEREAS, the Planning Commission recommended approval for the Negative <br />Declaration prepared for this project; and <br /> <br />WHEREAS, the Planning Commission determined that the proposed modification <br />would be consistent with other recently approved projects in the area and <br />would not alter the natural topographical features of the area. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON RESOLVES THE FOLLOWING: <br /> <br />Section 1. Recommends approval of Case PUD-93-02-09M, the application of <br />Barnabas Nagy for a major modification to the Ruby Hill PUD <br />development plan to: (1) relocate the existing sales office building on <br />Ruby Hill Boulevard northwesterly along Vineyard Avenue; (2) change the <br />existing office use to restaurant use; (3) revise the configuration of the <br />existing parking lot; (4) establish a new driveway off of Vineyard Avenue; <br />and (5) establish a pad location and design guidelines for a future <br />single-family residence at the property located at 2001 Ruby Hill <br />Boulevard, subject to the conditions shown in Exhibit B, attached hereto <br />and made part of this case by reference. <br /> <br />
