PC-2007-21 <br /> <br /> <br />RESOLUTION RECOMMENDING APPROVAL OF A NEGATIVE DECLARATION <br />FOR THE APPLICATION OF BARNABAS NAGY, <br />AS FILED UNDER CASE PUD-93-02-09M/PCUP-182 <br /> <br />WHEREAS, Barnabas Nagy has applied for: (1) a major modification to the Ruby Hill <br />PUD development plan to: (a) relocate the existing sales office building <br />on Ruby Hill Boulevard northwesterly along Vineyard Avenue; (b) change <br />the existing office use to restaurant use; (c) revise the configuration of the <br />existing parking lot; (d) establish a new driveway off of Vineyard Avenue; <br />and (e) establish a pad location and design guidelines for a future <br />single-family residence; and (2) conditional use permit to allow alcoholic <br />beverage service after 10:00 p.m. at the restaurant, at the property located <br />at 2001 Ruby Hill Boulevard; and <br /> <br />WHEREAS, the Planning Commission received and reviewed the Initial Study, dated <br />May 3, 2007 and received the recommendation of staff; and <br /> <br />WHEREAS, at its meeting of May 9, 2007, the Planning Commission received a <br />proposed Negative Declaration for Case PUD-93-02-09M/PCUP-182; and <br /> <br />WHEREAS, the public was given the opportunity to comment on the environmental <br />impacts of the proposal; and <br /> <br />WHEREAS, the Planning Commission has reviewed the potential impacts in <br />accordance with the applicable State and local guidelines governing the <br />preparation of Negative Declarations; and <br /> <br />WHEREAS, the Planning Commission finds that approval of the proposed project <br />would not have any significant adverse effects on the site’s wildlife. <br /> <br /> <br />
