<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-2007-20 <br /> <br />RESOLUTION RECOMMENDING APPROVAL OF THE APPLICATION OF EMIL <br />OXSEN AND KATHLEEN MORRISON FOR PLANNED UNIT DEVELOPMENT <br />REZONING AND DEVELOPMENT PLAN APPROVAL, <br />AS FILED UNDER CASE PUD-61 <br /> <br />WHEREAS, Emil Oxsen and Kathleen Morrison have applied for Planned Unit <br />Development (PUD) rezoning of an approximately 10,669-square-foot <br />parcel from the R-1-6,500 (Single-Family Residential) District to the <br />PUD-HDR (Planned Unit Development – High Density Residential) District <br />and for development plan approval to allow the existing 1,118-square-foot <br />and 1,200-square-foot single-family detached units and detached garage <br />located at 403 St. Mary Street and 730 Peters Avenue; and <br /> <br />WHEREAS, at its duly noticed public hearing of May 9, 2007, the Planning <br />Commission considered all public testimony, relevant exhibits, and <br />recommendations of the City staff concerning this application; and <br /> <br />WHEREAS, projects of this nature are categorically exempt from the requirements of <br />the California Environmental Quality Act (CEQA) under Class 15, <br />Section 15315 Minor Land Divisions; and <br /> <br />WHEREAS, the Planning Commission determined that the proposed rezoning and <br />development plan are appropriate for the site; and <br /> <br />WHEREAS, the Planning Commission made the following findings: <br /> <br />1. The plan is in the best interests of the public health, safety, and <br />general welfare. <br /> <br />The proposed development, as conditioned, meets all applicable City <br />standards concerning public health, safety, and welfare including vehicle <br />access, geologic, and flood hazards. The proposed development involves <br />no new construction and already has adequate storm drain, sanitary <br />sewer, water service, and utilities that are sufficient to serve the <br />development. Public street access is provided to all structures for police, <br />fire, and other emergency response vehicles. Therefore, this finding can <br />be made. <br /> <br /> <br />
