PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC-2007-14 <br />RESOLUTION APPROVING A CONDITIONAL USE PERMIT FOR MANITO <br />CONSTRUCTION, INC., AS FILED UNDER CASE PCUP-189 <br />WHEREAS, Manito Construction, Inc. has applied for a conditional use permit to operate a <br />construction and construction-related business office at 1043 Serpentine Lane, <br />Unit I; and <br />WHEREAS, zoning for the property is PUD-C-O (Planned Unit Development - <br />Commercial-Office) District; and <br />WHEREAS, at its duly noticed public hearing of April 11, 2007, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application; and <br />WHEREAS, this project is categorically exempt from environmental review pursuant to <br />California Environmental Quality Act Guidelines, Section 15301, Existing <br />Facilities, Class 1; and <br />WHEREAS, the Planning Commission made the following findings: <br />The proposed location of the conditional use is in accordance with the objectives of the <br />zoning ordinance and the purpose of the district in which the site is located. <br />The objectives of the zoning ordinance include fostering a harmonious, convenient, workable <br />relationship among land uses; protecting existing land use from inharmonious influences and <br />harmful intrusions; and ensuring that public and private lands ultimately are used for the <br />purposes which are most appropriate and beneficial to the City as a whole. Manito Construction, <br />Inc. would be operated primarily within the existing building. With the proposed conditions, the <br />proposed use would be operated in such a manner that it would conform to PUD-80-O1 and <br />would result in minimal disturbance to the nearby businesses and residents. The proposed uses <br />would be compatible uses in the building. <br />The subject sites are in the Valley Business Park, a business park that is dominated by businesses <br />that involve office/warehousing. As described by the business owner, Manito Construction, Inc. <br />will not generate any unusual demands on the existing parking for the subject site or the <br />surrounding properties. In addition, the conditions of the approvals require the applicant to <br />mitigate any nuisances that may occur as a result of their proposed businesses. Therefore, this <br />finding can be made. <br />
