PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC-2007-13 <br />RESOLUTION APPROVING A CONDITIONAL USE PERMIT FOR GORMAN ROOFING, <br />AS FILED UNDER CASE PCUP-189 <br />WHEREAS, Gorman Roofing has applied for a conditional use permit to operate a construction <br />and construction-related business office at 1040 Serpentine Lane, Unit 203; and <br />WHEREAS, zoning for the property is PUD-C-O (Planned Unit Development - <br />Commercial-Office) District; and <br />WHEREAS, at its duly noticed public hearing of April 11, 2007, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application; and <br />WHEREAS, this project is categorically exempt from environmental review pursuant to <br />California Environmental Quality Act Guidelines, Section 15301, Existing <br />Facilities, Class 1; and <br />WHEREAS, the Planning Commission made the following findings: <br />1. The proposed location of the conditional use is in accordance with the objectives of the <br />zoning ordinance and the purpose of the district in which the site is located. <br />The objectives of the zoning ordinance include fostering a harmonious, convenient, workable <br />relationship among land uses; protecting existing land use from inharmonious influences and <br />harmful intrusions; and ensuring that public and private lands ultimately are used for the <br />purposes which are most appropriate and beneficial to the City as a whole. Gorman Roofing <br />would be operated primarily within the existing building. With the proposed conditions, the <br />proposed use would be operated in such a manner that it would conform to PUD-80-O1 and <br />would result in minimal disturbance to the nearby businesses and residents. The proposed uses <br />would be compatible uses in the building. <br />The subject sites are in the Valley Business Park, a business park that is dominated by businesses <br />that involve office/warehousing. As described by the business owner, Gorman Roofing will not <br />generate any unusual demands on the existing parking for the subject site or the surrounding <br />properties. In addition, the conditions of the approvals require the applicant to mitigate any <br />nuisances that may occur as a result of their proposed businesses. Therefore, this finding can be <br />made. <br />
