PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC-2007-10 <br />RESOLUTION DENYING THE APPEAL OF PETER AND GARRETT NOWAK, THEREBY <br />UPHOLDING THE ZONING ADMINISTRATOR'SAPPROVAL OF A VARIANCE FROM <br />THE PLEASANTON MUNICIPAL CODE, AS FILED UNDER CASE PAP-103 (PV-140) <br />WHEREAS, Peter and Garrett Nowak have applied for a variance from the Pleasanton <br />Municipal Code to retain an existing trellis on the southern side of the house <br />located at 3590 Glacier Court South that does not comply with the minimum side <br />yard setback; the trellis is set back zero feet from the southern side property line <br />where a minimum three-foot setback is required; and <br />WHEREAS, zoning for the property is R-1-6,500 (Single-Family Residential) District; and <br />WHEREAS, on December 7, 2006, the Zoning Administrator approved the variance with a <br />requirement that the applicant modify the existing trellis to provide atwo-foot <br />southern side setback to the unsupported overhang and at least athree-foot <br />southern side setback to the support posts; and <br />WHEREAS, on December 26, 2006, the applicants filed an appeal of the Zoning <br />Administrator's decision to the Planning Commission; and <br />WHEREAS, at its duly noticed public hearing of February 28, 2007, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application; and <br />WHEREAS, projects of this nature are categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA); and <br />WHEREAS, the Planning Commission was not able to make the findings for the variance. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br />Section 1. Denies Case PAP-103, the appeal of Peter and Garrett Nowak, thereby upholding <br />the Zoning Administrator's approval of Case PV-140 to retain an existing trellis <br />on the southern side of the house located at 3590 Glacier Court South with a <br />requirement that the applicant modify the existing trellis to provide atwo-foot <br />southern side setback to the unsupported overhang and at least athree-foot <br />southern side setback to the support posts. <br />
