PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC-2007-08 <br />RESOLUTION RECOMMENDING APPROVAL OF THE APPLICATION OF PETER <br />SHUTTS/GOBLE PROPERTIES FOR A MA7OR MODIFICATION TO A PLANNED UNIT <br />DEVELOPMENT, AS FILED UNDER CASE PUD-85-10-7M <br />WHEREAS, Peter Shutts/Goble Properties has applied for a major modification and <br />development plan to demolish the existing drive-through bank building and <br />related site improvements and construct an approximately 2,530-square-foot, <br />one-story commercial building in its place at the property located at 5765 Valley <br />Avenue; and <br />WHEREAS, zoning for the property is PUD-C-C (Planned Unit Development - <br />Central-Commercial) District; and <br />WHEREAS, at its duly noticed public hearing of February 14, 2007, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application; and <br />WHEREAS, in urbanized areas, the construction of a new commercial building of <br />10,000 square feet or less is categorically exempt (Class 3) from the requirements <br />of the California Environmental Quality Act (CEQA); furthermore, in-fill <br />development projects on sites of five acres or less that have no habitat for <br />endangered, rare, or threatened species, that can be adequately served by all the <br />required utilities and public services, that are consistent with the General Plan and <br />zoning regulations, and would have no significant effect on traffic, noise, air <br />quality, or water quality are also categorically exempt (Class 32) from CEQA; <br />and this project meets the conditions of the Class 3 and Class 32 exemptions; and <br />WHEREAS, the Planning Commission determined that the proposed modification would be <br />consistent with other recently approved projects in the area and the appearance of <br />the existing buildings and would not alter the natural topographical features of the <br />area. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br />Section 1. Recommends approval of Case PUD-85-10-7M, the application of Peter <br />Shutts/Goble Properties for a major modification and development plan to <br />demolish the existing drive-through bank building and related site improvements <br />and construct an approximately 2,530-square-foot, one-story commercial building <br />in its place at the property located at 5765 Valley Avenue, subject to the <br />conditions shown in Exhibit B, attached hereto and made part of this case by <br />reference. <br />
