PLANNING COMMISSION <br />CITY OF PLEASANTON <br />- COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br />RESOLUTION N0. 2259 <br />A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY <br />OF PLEASANTON APPROVING A MITIGATED NEGATIVE DECLARATION <br />FOR TENTATIVE TRACT MAP 5114 AND 5115 AS SUBMITTED BY <br />CHANG SU-0 LIN <br />WHEREAS, Chang Su-0 Lin has applied for tentative subdivision approval of <br />a 50 lot residential subdivision of approximately 9.6 acres <br />of land located on the east side of Muirwood Drive between <br />Pecan Court and Lemonwood Way; and <br />WHEREAS, Chang Su-0 Lin has also applied for tentative subdivision approval <br />of a 71 unit townhouse residential subdivision of approximately <br />6.5 acres of land located on the east side of Muirwood Drive <br />between West Las Positas Boulevard and Pecan Court; and <br />WHEREAS, zoning for the above proposed subdivision is PUD (Planned Unit <br />Development)-Medium Density Residential and PUD (Planned Unit <br />Development)-High Density Residential Districts; and <br />WHEREAS, at their duly noticed public hearing of January 12, 1983 the <br />Planning Commission considered all public testimony, relevant <br />-- maps and recommendation of the City staff concerning the proposed <br />tentative maps including the environmental impacts of the <br />proposed subdivisions; and <br />WHEREAS, the City Planning Commission has reviewed the potential impacts <br />in accordance with state and local guidelines governing the <br />preparation of negative declarations and environmental impact <br />reports; and <br />WHEREAS, the Initial Study prepared by the City staff indicated that there <br />may be a significant impact on the environment relating to <br />noise and water related impacts but conditions imposed upon <br />project approval would reduce those impacts to an insignificant <br />level. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON RESOLVES <br />THE FOLLOWING: <br />Section 1. Finds that based upon the review of the Initial Study, public <br />testimony and documentary evidence presented at the public hearing <br />that there could be a significant adverse impact upon the environment <br />as a result of project approval but that conditions imposed upon <br />project approval would reduce those impacts to an insignificant level. <br />Section 2. Approves the Mitigated Negative Declaration for Tentative <br />Subdivision Maps 5114 and 5115 as described herein. <br />Section 3. This resolution shall become effective 15 days after its passage <br />and adoption. <br />
