PLANNING COM[~4ISSION <br />CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br />RESOLUTION NO. 2269 <br />A RESOLUTION OF THE CITY OF PLEASANTON APPROVING <br />A USE PERMIT FOR MORRISON HOMES CORPORATION AS <br />FILED UNDER CASE UP-83-3 <br />WHEREAS, Morrison Homes Corporation has filed for a conditional <br />use permit to operate a four lot model home sales complex <br />and a temporary sales trailer on the east side of Kolln <br />Street at its intersection with Orloff Drive (Lots 1-4 & <br />58, Tract 4890); and <br />WHEREAS, zoning for the property is PUD (Planned Unit Development)- <br />Medium Density Residential District; and <br />WHEREAS, at their duly noticed public hearing of February 23, 1983 <br />the Planning Commission considered all public tes*_imony, <br />related exhibits and recommendations of the City Staff; and <br />WHEREAS, the Planning Commission found that the proposed location <br />of the conditional use is in accord with the objectives <br />of this chapter and the purposes of the district in which <br />the site is located; and <br />WHEREAS, the Planning Commission found that the proposed location <br />of the conditional use and the conditions under which it <br />would be operated or maintained will not be detrimental <br />to the public health, safety or welfare or be materially <br />injurious to properties or improvements in the vicinity; and <br />WHEREAS, the Planning Commission found that the proposed conditional <br />use will comply with each of the applicable provisions of <br />the Zoning Ordinance. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br />Section 1. Approves case UP-83-3, application of Morrison homes <br />to operate a four lot model home sales complex and <br />a temporary sales trailer on the east side of Kolln Street <br />at its intersection with Orloff Drive subject to the <br />conditions shown on Exhibit "A", attached hereto and made <br />part of this case by reference. <br />Section 2. This resolution shall become effective 15 days following <br />the date on which the use permit was granted or on the day <br />following the next meeting of the Council, whichever is <br />later, unless an appeal has been taken to the Council or <br />unless the Council shall elect to review the decision of <br />the Commission. <br />
