~~ <br />PLANNING COMMISSION <br />__ CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br />RESOLUTION N0. 2270 <br />A RESOLUTION OF THE PLANNING COMMISSION OF <br />THE CITY OF PLEASANTON APPROVING A USE PERMIT <br />FOR HOMESTEAD DEVELOPMENT COMPANY AS FILED <br />UNDER CASE UP-83-2 <br />WHEREAS, Homestead Development Company has applied for conditional <br />use permit approval to operate a four lot model home <br />sales complex and a temporary sales trailer on the <br />north side of Oakland Avenue at its intersection with <br />Rheem Drive (Lots 1-8, Tract 5062); and <br />WHEREAS, zoning for the property is PUD (Planned Unit Development)- <br />Medium Density Residential District; and <br />WHEREAS, at their duly noticed public hearing of February 23, 1983 <br />the Planning Commission considered all public testimony, <br />related exhibits and recommendations of the City Staff; and <br />WHEREAS, the Planning Commissipn found that the proposed location <br />of the conditional use is in accord with the objectives <br />l- of this chapter and the purposes of the district in which <br />the site is located; and <br />WHEREAS, the Planning Commission found that the proposed location of <br />the conditional use and the conditions under which it would <br />be operated or maintained will not be detrimental to the <br />public health, safety or welfare or be materially injurious <br />to properties or improvements in the vicinity; and <br />WHEREAS, the Planning Commission found that the proposed conditional <br />use will comply with each of the applicable provisions <br />of the Zoning Ordinance. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br />Section 1. Approves case UP-83-2, application of Homestead Development <br />Company for a conditional use permit to operate a four lot <br />model home sales complex and a temporary sales trailer on <br />the north side of Oakland Avenue at its intersection with <br />Fheem Drive subject to the conditions shown on Exhibit "A", <br />attached hereto and made part of this case by reference. <br />Section 2. This resolution shall become effective 15 days following <br />the date on which the use permit was granted or on the day <br />following the next meeting of the Council, whichever is later, <br />unless an appeal has been taken to the Council or unless the <br />Council shall elect to review the decision of the Commission. <br />
