~~ PLANNING COMMISSION __ CITY OF PLEASANTON COUNTY OF ALAMEDA STATE OF CALIFORNIA RESOLUTION N0. 2270 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PLEASANTON APPROVING A USE PERMIT FOR HOMESTEAD DEVELOPMENT COMPANY AS FILED UNDER CASE UP-83-2 WHEREAS, Homestead Development Company has applied for conditional use permit approval to operate a four lot model home sales complex and a temporary sales trailer on the north side of Oakland Avenue at its intersection with Rheem Drive (Lots 1-8, Tract 5062); and WHEREAS, zoning for the property is PUD (Planned Unit Development)- Medium Density Residential District; and WHEREAS, at their duly noticed public hearing of February 23, 1983 the Planning Commission considered all public testimony, related exhibits and recommendations of the City Staff; and WHEREAS, the Planning Commissipn found that the proposed location of the conditional use is in accord with the objectives l- of this chapter and the purposes of the district in which the site is located; and WHEREAS, the Planning Commission found that the proposed location of the conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety or welfare or be materially injurious to properties or improvements in the vicinity; and WHEREAS, the Planning Commission found that the proposed conditional use will comply with each of the applicable provisions of the Zoning Ordinance. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON RESOLVES THE FOLLOWING: Section 1. Approves case UP-83-2, application of Homestead Development Company for a conditional use permit to operate a four lot model home sales complex and a temporary sales trailer on the north side of Oakland Avenue at its intersection with Fheem Drive subject to the conditions shown on Exhibit "A", attached hereto and made part of this case by reference. Section 2. This resolution shall become effective 15 days following the date on which the use permit was granted or on the day following the next meeting of the Council, whichever is later, unless an appeal has been taken to the Council or unless the Council shall elect to review the decision of the Commission.
