THE CITY OF 1 6 <br />-- ~~~°°~'~- "'' CITY COUNCIL AGENDA REPORT <br />j~L£~S~NTONo <br />July 17, 2007 <br />Public Works Department <br />TITLE: APPROVAL OF REIMBURSEMENT AGREEMENT WITH APPLIED <br />BIOSYSTEMS (6001 SUNOL BOULEVARD) FOR INFRASTRUCTURE <br />CONSTRUCTED BEYOND ITS SUNOL BOULEVARD FRONTAGE <br />SUMMARY <br />Applied Biosystems had received approval to construct a 960,000 square foot office and <br />research campus on the 80-acre parcel northeast of I-680 and west of Sunol Boulevard. <br />To date, less than half of the building space has been constructed. As part of the off-site <br />mitigation for this project, Applied Biosystems widened Sunol Boulevard between I-680 <br />and Valley Avenue (Junipero Street) including a pavement overlay with sound- <br />attenuating open-graded asphalt. This work has been completed and the street <br />improvements have been in use for several years. At this time, Applied Biosystems is <br />asking the City to establish a reimbursement agreement whereby property along Sunol <br />Boulevard that benefited from the street widening would pay Applied Biosystems apro- <br />rata share of the cost of the improvements when those properties either subdivide or <br />redevelop. <br />Staff is recommending approval of the reimbursement agreement with Applied <br />Biosystems for street improvements constructed along Sunol Boulevard. <br />RECOMMENDATION <br />1. Approve the attached Reimbursement Agreement with Applied Biosystems <br />(Attachment 2) for the infrastructure constructed beyond its Sunol Boulevard <br />frontage. <br />2. Authorize the City Manager to execute the agreement. <br />FINANCIAL STATEMENT <br />As is now standard for the City's reimbursement agreements, the City will retain 10% of <br />any collected fees for its administrative costs. Th+s administrative fee is justified in light of <br />the time it takes City staff to analyze the costs that are subject to reimbursement. <br />
