THE CITY OF 1 6 -- ~~~°°~'~- "'' CITY COUNCIL AGENDA REPORT j~L£~S~NTONo July 17, 2007 Public Works Department TITLE: APPROVAL OF REIMBURSEMENT AGREEMENT WITH APPLIED BIOSYSTEMS (6001 SUNOL BOULEVARD) FOR INFRASTRUCTURE CONSTRUCTED BEYOND ITS SUNOL BOULEVARD FRONTAGE SUMMARY Applied Biosystems had received approval to construct a 960,000 square foot office and research campus on the 80-acre parcel northeast of I-680 and west of Sunol Boulevard. To date, less than half of the building space has been constructed. As part of the off-site mitigation for this project, Applied Biosystems widened Sunol Boulevard between I-680 and Valley Avenue (Junipero Street) including a pavement overlay with sound- attenuating open-graded asphalt. This work has been completed and the street improvements have been in use for several years. At this time, Applied Biosystems is asking the City to establish a reimbursement agreement whereby property along Sunol Boulevard that benefited from the street widening would pay Applied Biosystems apro- rata share of the cost of the improvements when those properties either subdivide or redevelop. Staff is recommending approval of the reimbursement agreement with Applied Biosystems for street improvements constructed along Sunol Boulevard. RECOMMENDATION 1. Approve the attached Reimbursement Agreement with Applied Biosystems (Attachment 2) for the infrastructure constructed beyond its Sunol Boulevard frontage. 2. Authorize the City Manager to execute the agreement. FINANCIAL STATEMENT As is now standard for the City's reimbursement agreements, the City will retain 10% of any collected fees for its administrative costs. Th+s administrative fee is justified in light of the time it takes City staff to analyze the costs that are subject to reimbursement.
