ATTACHMENT 1 <br />ORDINANCE NO. <br />AN ORDINANCE APPROVING THE APPLICATION OF CHRISTOPHER <br />ANDREWS AND DARRELL SCHERBARTH FOR PUD DEVELOPMENT PLAN <br />APPROVAL, AS FILED UNDER CASE PUD-60 <br />WHEREAS, Christopher Andrews and Darrell Scherbarth have applied for PUD <br />development plan approval to demolish an existing 2,125-square-foot home and to <br />subdivide the parcel into three lots to construct three custom homes at the <br />property located at 2500 Vineyard Avenue, within the Vineyard Avenue Corridor <br />Specific Plan Area; and <br />WHEREAS, zoning for the property is PUD-LDR/OS (Planned Unit Development- <br />Low Density Residential/Open Space) District; and <br />WHEREAS, an environmental review for the proposed project was undertaken <br />with the Environmental Impact Report (EIR) for the Vineyard Avenue Corridor Specific <br />Plan, certified by the City Council on March 1999; and <br />WHEREAS, the California Environmental Quality Act (CEQA) specifies that <br />individual residential development projects that are prepared pursuant to the <br />requirements of an adopted specific plan, for which an EIR has been prepared and <br />certified, are exempt from additional environmental review; and <br />WHEREAS, at its meeting of March 20, 2007, the City Council received the <br />Planning Commission's positive recommendations for approval of the PUD <br />development plan; and <br />WHEREAS, a duly noticed public hearing was held on March 20, 2007; and <br />WHEREAS, after a review of the materials presented, the City Council finds that <br />the PUD development plan is consistent with the General Plan policies and the <br />purposes of the PUD ordinance of the City of Pleasanton. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br />HEREBY ORDAIN AS FOLLOWS: <br />SECTION 1. Approves Case PUD-60, the application of Christopher Andrews <br />and Darrell Scherbarth for PUD development plan approval to demolish an <br />existing 2,125-square-foot home and to subdivide the parcel into three lots <br />to construct three custom homes at the property located at 2500 Vineyard <br />Avenue, within the Vineyard Avenue Corridor Specific Plan Area, subject to <br />the conditions shown on Exhibit B, attached hereto and incorporated herein by <br />this reference. <br />
