THE CITY OF i 9 <br />u~ ~ <br />~'L£~S~4NTON® CITY COUNCIL AGENDA REPORT <br />March 20, 2007 <br />Planning and Community Development <br />TITLE: PUD-85-10-7M, PETER SHUTTS/GOBLE PROPERTIES -CONSIDER <br />AN APPLICATION FORA PLANNED UNIT DEVELOPMENT (PUD) <br />MAJOR MODIFICATION AND DEVELOPMENT PLAN TO DEMOLISH <br />THE EXISTING DRIVE-THROUGH BANK BUILDING AND RELATED <br />SITE IMPROVEMENTS AND CONSTRUCT AN APPROXIMATELY <br />2,530-SQUARE-FOOT, ONE-STORY COMMERCIAL BUILDING IN ITS <br />PLACE AT THE PROPERTY LOCATED AT 5765 VALLEY AVENUE. <br />PROPERTY OWNER: Goble Properties <br />GENERAL PLAN: Retail, Highway, and Service Commercial; Business and <br />Professional Offices <br />ZONING: PUD-C-C (Planned Unit Development -Central-Commercial) District <br />SUMMARY <br />The applicants propose to demolish the vacant bank building and construct a new <br />commercial building in its place, which would include Peet's Coffee and Tea as one of <br />the tenants. Staff and the Planning Commission believe that the project, as <br />conditioned, is well designed and will be compatible with the surrounding area. The <br />applicants are in agreement with the Planning Commission's recommended conditions <br />of approval. <br />PLANNING COMMISSION RECOMMENDATION <br />The Planning Commission recommended approval of the application (4-0 vote), subject <br />to the conditions of approval recommended by staff, with a modification to the uses to <br />prohibit fryers and grills on the subject property. <br />RECOMMENDATION <br />1. Find that the proposed PUD major modification and development plan are consistent <br />with the General Plan and purposes of the PUD ordinance; <br />2. Make the PUD findings for the proposed development plan as stated in the February <br />14, 2007, Planning Commission staff report (Attachment #7); and <br />3. Introduce the attached draft ordinance approving Case PUD-85-10-7M, subject to <br />the Conditions of Approval, Exhibit "B." <br />
