CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 90-23 <br /> <br />RESOLUTION PERMITTING CITY OF PTmASANTON <br />TO JOINT IN AMICUS BRIEF <br /> <br />WHEREAS, <br /> <br />there is pending in the Supreme Court of <br />California, the matter of Lesher Communications v. <br />City of Walnut Creek, in which the Supreme Court <br />will decide whether a citizen's initiative can be <br />construed as a general plan amendment; and <br /> <br />WHEREAS, <br /> <br />an adverse ruling to the City of Walnut Creek would <br />place tremendous burdens on the ability of local <br />government to respond to complex planning <br />requirements in the face of initiatives generated <br />by citizens; and <br /> <br />WHEREAS, <br /> <br />the law firm of Freilich, Stone, Leitner & Carlisle <br />is writing the amici curiae (friends of the court) <br />brief in which other cities may join at no cost; <br />and <br /> <br />WHEREAS <br /> <br />the City Attorney has recommended to the City <br />Council that the City of Pleasanton be added to the <br />brief, at no out of pocket expense to the local <br />taxpayers. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />-Section 1: The City Council hereby approves joinder of the <br /> City of Pleasanton in the amici curiae brief in the <br /> case of Lesher Communications v. City of Walnut <br /> Creek, pending in the Supreme Court of California, <br /> such participation to be at no out of pocket <br /> expense to the City of Pleasanton. <br /> <br />Section 2: This resolution shall become effective <br /> immediately upon its passage and adoption. <br /> <br /> <br />
