CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 90-18 <br /> <br />RESOLUTION VACATING A PORTION OF A PUBLIC <br />SERVICE EASEMENT ON LOTS 56A AND 58 OF <br />PARCEL MAP 3863 <br /> <br />WHEREAS, <br /> <br />at its meeting of February 6, 1990, Council <br />reviewed the staff report (SR 90:42) recommending <br />vacation of a portion of the public service <br />easement on Lots 56A and 58 of Parcel Map 3863, <br />more particularly described on Exhibit "A" attached <br />hereto and incorporated herein by this reference; <br />and <br /> <br />WHEREAS, <br /> <br />the portion of public service easement is no longer <br />required due to relocation of the Hacienda <br />interchange right-of-way, which created a shift in <br />property lines and left portions of the public <br />service easement within the interchange right-of- <br />way; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Pursuant to Chapter 4 of the Streets and Highways <br /> Code and based upon the findings above establishing <br /> that the public service easement is not required <br /> due to relocation pursuant to Section 8333 of the <br /> Streets and Highways Code, the portion of the <br /> public service easement described in Exhibit "A" is <br /> hereby vacated. <br /> <br />Section 2: <br /> <br /> The City Clerk shall cause a certified copy of <br />this resolution of vacation to be recorded in the <br />Office of the Alameda County Recorder. <br /> <br />Section 3: <br /> <br /> That from and after the date the resolution is <br />recorded, the public service easement vacated no <br />longer constitutes a public service easement. <br /> <br />Section 4: This resolution shall become effective <br /> immediately upon its passage and adoption. <br /> <br /> <br />
