CONTRACT LIGHTING AND LANDSCAPE MAINTENANCE DISTRICT 1995-1 MOLLER RANCH, 2006-2007 THIS CONTRACT is made and entered into this 8th day of June, 2006, by and between Del Conte's Landscaping, Inc., ("Contractor"), whose address is 41900 Boscell Road, Fremont, CA 94538, and telephone number is (510) 353-6030, and the CITY OF PLEASANTON, a municipal corporation ("City"). WITNESSETH: WHEREAS, the City has awarded to the Contractor a contract for the Lighting and Landscape Maintenance District 1995-1 Moller Ranch. NOW, THEREFORE, in consideration of the mutual promises set forth herein, the parties agree as follows: I. Work to be Performed. The areas to be maintained are briefly described as follows: Designated landscaped areas, open space slopes, fuel transition zones (fire breaks), open space drainage ditches, irrigation systems, trees in the open space and designated landscaped areas, and all appurtenant and incidental expenses within Tract 6618, City of Pleasant on. Contract Renewal ODtion It should be noted that the City and the successful bidder shall retain the right to renew the signed Contract agreement for an additional one year period up to, but not exceeding, four additional years. This Contract may be renewed only by mutual agreement between the parties involved. Each party retains the right to not renew the agreement at the time of its annual review. If the parties agree that the terms shall continue, the base contract amount shall be increased annually, beginning on July 1, 2007, by the percentage published in Engineering News Record (ENR) Construction Cost Index for San Francisco. The only items that shall be subject to negotiation are the following: 1. additional items of work; and 2. new plantings and associated maintenance. This contract is for the first year of maintenance, for the period from July 1, 2006, through June 30, 2007. The base contract amount is $26,400.00 per year. I
