CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 92-21 <br /> <br /> RESOLUTION PERMITTING CITY OF PT~ASANTON TO <br /> JOIN IN AMICUS BRIEF <br /> <br />WHEREAS, there is pending in the United States Supreme Court of <br /> the State of California the matter of Lucas v. South <br /> Carolina Coastal Commission, in which important issues <br /> concerning when public regulations constitute a taking of <br /> private property; and <br /> <br />WHEREAS, an amicus curiae (friend of the court) brief is being <br /> written in which other cities may join at no cost; and <br /> <br />WHEREAS, the City Attorney has recommended to the City Council <br /> that the City of Pleasanton be added to the amicus curiae <br /> brief, at no out-of-pocket expense to the local <br /> taxpayers. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: The City Council hereby approves joinder of the City of <br /> Pleasanton in the amicus curiae brief in the case of <br /> Lucas v. South Carolina Coastal Commission, pending in <br /> the United States Supreme Court, such participation to be <br /> at no out-of-pocket expense to the City of Pleasanton. <br /> <br />Section 2: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br /> I HEREBY CERTIFY THAT THE FOREGOING WAS DULY AND <br />REGULARLY ADOPTED BY THE CITY COUNCIL OF THE CITY OF PLEASANTON, AT <br />A MEETING HELD ON JANUARY 21, 1992, BY THE FOLLOWING VOTE: <br /> <br />AYES: Councilmembers - Mohr, Scribner, Tarver, and Mayor Mercer <br />NOES: None <br />ABSENT: Councilmember Butler <br />ABSTAIN: None <br /> ATTEST: <br /> <br /> Peggy~fX. ~zidroJCity Clerk <br />APPROVED AS TO FO : <br /> <br />Michael H.
