BOX 520 <br />PLEASANTON, CA 94566 ALA1VIBDA COLrNTY, CALIFORNIA <br />ATTN: CITY MANAGER <br /> R~OLUTION NO. 94-15 <br /> <br /> A RESOLUTION ABANDONING THE CITY OF <br /> PLEASANTON'S INTEREST IN CERTAIN PARCELS <br /> WYFRIN TR_ACT 6!t~2, ACCEPTING FEE TITLE FOR A <br /> PORTION OF PROPERTY WITHIN TRACT 6362 FOR <br /> STREET WIDENING PURPOSES, CONDITIONALLY <br /> APPROVING PARCEL MAP 6697 REVERTING CERTAIN <br /> PROPERTY TO ACREAGE, TERMINATING VARIOUS <br /> AGREEMF~NTS WITH A-M HO1VIF, S, AND AUTHORIZING <br /> THE RETURN OF CERTAIN FEES AND DEPOSITS TO A-M <br /> HOMES <br /> <br /> WHEREAS, in 1990, the City approved a planned unit development plan for the Garms <br /> Ranch, a 115+ acre site located west of Foothill Road and south of Tehan <br /> Canyon Court; and <br /> <br /> WHEREAS, thereafter, A-M Homes, the project developer, applied for and received growth <br /> management approval for the project, which approval is set forth in that certain <br /> Growth Management Agreement, between A-M Homes, a California Limited <br /> Partnership, and the City of Pleasanton, dated June 25, 1990 and recorded <br /> September 12, 1990, Instrument No. 90-243052, Alameda County Records; and <br /> <br /> WHEREAS, A-M Homes applied for and received conditional approval of a tentative map to <br /> subdivide the property into 48 residential lots; and <br /> <br /> WHEREAS, in January 1993, after posting the applicable bonds and paying all applicable fees, <br /> A-~I Homes ~cci the final map (Tract 6362) for this project and entered into a <br /> Subdivision Agreement and an Indemnity Agreement with the City, which <br /> Indemnity Agreement is dated January 8, 1993 and recorded March 5, 1993, <br /> Instrument No. 93-072661, Alameda County records; and <br /> <br /> WI-I~.REAS, the final map created an open space parcel, to be conveyed to the City, and a <br /> parcel for a water xeservoir, also to be conveyed to the City; and <br /> <br /> WHEREAS, A-M Homes has reached an agreement to sell Tract 6362 to the East Bay <br /> Regional Park District; the District, however, does not want to purchase the <br /> property encumbered by development project approvals and wishes to buy, <br /> essentially, raw acreage consistent with the purpose for which the District intends <br /> to use the land; and <br /> <br /> WHEREAS, reversions to acreage are governed solely by the State Subdivision Map Act; and <br /> <br /> <br />
