CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 98-11 RESOLUTION UPHOLDING THE APPEAL AND APPROVING THE APPLICATION OF GREENBRIAR SYCAMORE VALLEY COMPANY FOR A CONDITIONAL USE PERMIT AS FILED UNDER CASE UP-97-27 WHEREAS, Greenbriar Sycamore Valley Company applied to the City for a comprehensive conditional use permit to allow secondary-units to be offered as a builder option for the 111 single-family residential unit subdivision on Sycamore Road; and WHEREAS, zoning for the property is PUD (Planned Unit Development) - LDR/A (Low Density Residential/Agricultural) District; and WHEREAS, at its meeting of December 10, 1997, the Planning Commission was unable to make the finding that the project was consistent with the General Plan and therefore did not approve the application; and WHEREAS, within the time specified by the Pleasanton Municipal Code, the applicant appealed the decision to the City Council; and WHEREAS, the City Council conducted a public hearing on the appeal and considered the staff report of the Planning Director (SR 98:27) and all written and oral evidence submitted conceming the use permit; and WHEREAS, the City Council finds that the conditional use permit is consistent with the General Plan, the North Sycamore Specific Plan, and the PUD ordinance adopted for this project; and WHEREAS, an Environmental Impact Report was prepared and certified for the North Sycamore Specific Plan, and the California Environmental Quality Act specifies that individual residential development projects that are prepared pursuant to the requirements of an adopted specific plan, for which an E1R has been prepared and certified are exempt from additional environmental review; therefore, no additional environmental document was prepared for this application; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS:
