CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 98-11 <br /> <br /> RESOLUTION UPHOLDING THE APPEAL AND <br /> APPROVING THE APPLICATION OF GREENBRIAR <br /> SYCAMORE VALLEY COMPANY FOR A CONDITIONAL <br /> USE PERMIT AS FILED UNDER CASE UP-97-27 <br /> <br />WHEREAS, Greenbriar Sycamore Valley Company applied to the City for a comprehensive <br /> conditional use permit to allow secondary-units to be offered as a builder option <br /> for the 111 single-family residential unit subdivision on Sycamore Road; and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) - LDR/A (Low <br /> Density Residential/Agricultural) District; and <br /> <br />WHEREAS, at its meeting of December 10, 1997, the Planning Commission was unable to <br /> make the finding that the project was consistent with the General Plan and <br /> therefore did not approve the application; and <br /> <br />WHEREAS, within the time specified by the Pleasanton Municipal Code, the applicant <br /> appealed the decision to the City Council; and <br /> <br /> WHEREAS, the City Council conducted a public hearing on the appeal and considered the staff <br /> report of the Planning Director (SR 98:27) and all written and oral evidence <br /> submitted conceming the use permit; and <br /> <br /> WHEREAS, the City Council finds that the conditional use permit is consistent with the <br /> General Plan, the North Sycamore Specific Plan, and the PUD ordinance adopted <br /> for this project; and <br /> <br /> WHEREAS, an Environmental Impact Report was prepared and certified for the North <br /> Sycamore Specific Plan, and the California Environmental Quality Act specifies <br /> that individual residential development projects that are prepared pursuant to the <br /> requirements of an adopted specific plan, for which an E1R has been prepared and <br /> certified are exempt from additional environmental review; therefore, no additional <br /> environmental document was prepared for this application; <br /> <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br /> AS FOLLOWS: <br /> <br /> <br />
